WORKFORCE INNOVATION AND OPPORTUNITY ACT (WIOA)

The U.S. Departments of Labor and Education have collaboratively issued Workforce Innovation and Opportunity Act provisions related to performance accountability. The associated documents include a Participant Individual Record Layout, reporting calculation specifications, and quarterly and annual report templates. All of these documents have been approved by the Office of Management and Budget (OMB) for collection.

Announcing 60-day Public Comment Period for WIOA Joint ICR

  • March 23, 2020

    TEN 19-19 : To announce the approval and implementation of the non-material revision to the "Department of Labor (DOL)-only Performance Accountability, Information, and Reporting System" Information Collection Request (ICR) (DOL-only ICR) (OMB Control Number: 1205-0521), including the addition of program-specific Quarterly Performance Report (QPR) layouts. Attachment 1 includes a list of the PIRL revisions.

    TEGL 10-19 : Technical Assistance regarding the Submission Deadline for the Unified and Combined State Plans under the Workforce Innovation and Opportunity Act (WIOA) for Program Years (PYs) 2020-2023 and Other Related Requirements. The purpose is to provide an update on technical assistance to states, territories, and outlying areas related to the requirements for submitting PYs 2020-2023 Unified and Combined State Plans under sections 102 and 103 of WIOA. The PYs 2020-2023 Unified and Combined State Plans will cover the four-year period from July 1, 2020, through June 30, 2024.

  • January 2, 2020

    TEGL 08-19 : Workforce Innovation and Opportunity Act (WIOA) Title I Training Provider Eligibility and State List of Eligible Training Providers (ETPs) and Programs. The purpose of this guidance is to identify actions that states can take to meet requirements for training providers, program eligibility, and the state ETP list in WIOA Section 122 and 20 CFR part 680. WIOA and its regulations established the allowable types of training, including both work-based and classroom instruction, with the goal of ensuring provider performance, job-driven training, informed consumer choice, continuous improvement, and cost-effective investment of public funds. This guidance replaces Training and Employment Guidance Letter (TEGL) 41-14, Workforce Innovation and Opportunity Act (WIOA or Opportunity Act) Title I Training Provider Eligibility Transition, and the subsequent TEGL 41-14, Change 1 .

    TEGL 04-19 : Waiver Authority for the INA Program and Implementation of Additional Indicators of Performance. This guidance describes additional indicators of performance for the INA program, and provides guidance on submitting waivers to statutory and regulatory requirements, including to the primary indicators of performance at Section 116(b)(2)(A) of the Workforce Innovation and Opportunity Act (WIOA).

    TEGL 14-18 : Aligning Performance Accountability Reporting, Definitions, and Policies Across Workforce Employment and Training Programs Administered by the U.S. Department of Labor (DOL). This Training and Employment Guidance Letter (TEGL) aligns and streamlines performance indicators and requirements across 15 DOL Employment and Training Administration (ETA) programs to the Workforce Innovation and Opportunity Act (WIOA) performance indicators, while also rescinding and eliminating outdated performance guidance for these programs in addition to clarifying existing ETA performance accountability policies that changed due to WIOA.

    TEGL 08-18 : Workforce Innovation and Opportunity Act (WIOA) Title I and Wagner-Peyser Act Waiver Requirements and Request Process. This guidance communicates the requirements and the process for states to request a waiver of WIOA Title I or the Wagner-Peyser Act, and to provide information regarding available resources for developing waiver requests.

    TEGL 05-18 : Workforce Innovation and Opportunity Act (WIOA) Annual Statewide Performance Report Narrative

    To provide guidance to WIOA state grantees regarding the content of the WIOA Annual Statewide Performance Report Narrative for titles I and III and the procedures for submission to the Employment and Training Administration (ETA). The report is due annually on December 1, or the first business day thereafter should that date fall on a weekend. The PY 2017 report is due December 3, 2018

  • August 31, 2018
    TEGL 03-18 : ETA provides guidance to states on performance reporting on ETPs. Under WIOA, all states must collect and report performance information on all individuals and WIOA title I core program participants (of Adult, Dislocated Worker, and Youth programs) served by each program of study on the state list of Eligible Training Providers (ETP list). The requirements for ETP reporting can be found at WIOA section 116(d)(4) and 116(d)(6)(B) and in the WIOA Joint and Department of Labor (DOL)-only final rules at 20 CFR 677.230 and 20 CFR 680.490.
  • July 20, 2018
    TEN 02-18 : Timeline for the Use of the Amended Participant Individual Record Layout (PIRL) for Program Performance Reporting in the Workforce Integrated Performance System (WIPS). Purpose: To announce the timeline for data collection and reporting using the 2018 amended version of the PIRL for performance data collection and submission through WIPS.

  • April 4, 2018: 30-Day ICR: OMB Control Number 1205-0521

    SUMMARY: The Department of Labor (DOL) is submitting the Employment and Training Administration (ETA) sponsored information collection request (ICR) revision titled, "DOL-Only Performance Accountability, Information, and Reporting System," to the Office of Management and Budget (OMB) for review and approval for use in accordance with the Paperwork Reduction Act (PRA) of 1995. Public comments on the ICR are invited. The OMB will consider all written comments that agency receives on or before May 4, 2018.

  • January 12, 2018
    TEGL 05-17 : Workforce Investment Act Closeout Performance Reporting. The U.S. Department of Labor (DOL) requires the reporting of performance data, in accordance with Workforce Investment Act of 1998 (WIA) performance accountability provisions, for individuals served and exited prior to July 1, 2016, who were not previously reported for Program Year (PY) 2015.

  • January 8, 2018: Common Performance Reporting 30 Day ICR
    The Department of Labor (DOL) is submitting the Employment and Training Administration (ETA) sponsored information collection request (ICR) revision titled, "Workforce Innovation and Opportunity Act Common Performance Reporting," to the Office of Management and Budget (OMB) for review and approval for use in accordance with the Paperwork Reduction Act (PRA) of 1995. Public comments on the ICR are invited. The OMB will consider all written comments that agency receives on or before February 8, 2018.
  • TEGL 03-17 : WIOA Annual Performance Report Submission
    The U.S. Departments of Labor (DOL) and Education (ED) (collectively, Departments) are exercising their transition authority under section 503(a) of the Workforce Innovation and Opportunity Act (WIOA) to inform States that the Departments will consider Program Year (PY) 2016 WIOA Statewide and Local Performance Reports (form ETA-9169) submitted by October 16, 2017, as being timely. For all subsequent PYs, States must submit the WIOA Statewide and Local Performance Report by October 1 to be considered timely, pursuant to the "Workforce Innovation and Opportunity Act (WIOA) Performance Accountability, Information and Reporting System" information collection request (WIOA Joint Performance ICR).
  • TEGL 26-16 : Guidance on the use of Supplemental Wage Information to implement the Performance Accountability Requirements under the Workforce Innovation and Opportunity Act. The purpose of this guidance is to provide sub-regulatory guidance on the requirements established by the Workforce Innovation and Opportunity Act (WIOA) and its implementing regulations regarding the use of supplemental wage information, when appropriate, to assist in carrying out the performance accountability requirements under section 116 of WIOA.
  • TEGL 19-16 : Guidance on Services provided through the Adult and Dislocated Worker Programs under the Workforce Innovation and Opportunity Act (WIOA) and the Wagner-Peyser Act Employment Service (ES), as amended by title III of WIOA, and for Implementation of the WIOA Final Rules.
  • TEGL 10-16, Change 1 : Performance Accountability Guidance for Workforce Innovation and Opportunity Act (WIOA) Title I, Title II, Title III, and Title IV Core Programs. This guidance updates Training and Employment Guidance Letter (TEGL) 10-16 published December 19, 2016 developed jointly by the U.S. Departments of Labor (DOL) and Education (ED) (the Departments). Within ED, the Office of Career, Technical, and Adult Education (OCTAE) and the Rehabilitation Services Administration (RSA) will update Program Memorandum (PM) 17-2 and Technical Assistance Circular (TAC) 17-01 respectively. The updated guidance provides clarifying language and corrections to the operating parameters and to the calculations of the numerators and denominators for the WIOA primary indicators of performance.
  • WIA Closeout Report Important Information : ETA Provides Updates Instructions on WIOA Quarterly Reporting and WIA Closeout Report; Updates Content and Technical Assistance Material. Also, States must defer mandatory PIRL reporting for TAA Program until FY 2018.
