Pension And Welfare Benefits Administration Releases Field Assistance Bulletin on Multiemployer Plan Trustees

Washington, DC - The U.S. Department of Labor’s Pension and Welfare Benefits Administration today released Field Assistance Bulletin No. 2002-2 describing circumstances under which multiemployer trustees may be acting in a settlor, rather than a fiduciary, capacity. In addition, the FAB makes clear that, consistent with earlier plan expense guidance, expenses incurred by multiemployer trustees in connection with settlor activities cannot be paid by the plan.

The FAB is part of the department’s ongoing compliance assistance program to help employers, plan officials, service providers and others voluntarily comply with the Employee Retirement Income Security Act.
