Waiver Flexibility for Hurricane Katrina Recovery

Purpose

The purpose of this Training and Employment Guidance Letter (TEGL) is to provide states with a list of provisions of the Workforce Investment Act (WIA) that have previously been waived or new provisions that have not been waived but are within the statutory waiver authority under the WIA regulations at 20 CFR 661,440. These waivers will provide states with increased flexibility to respond to job seekers and business needs in hurricane-affected areas and areas receiving an influx or evacuees. Included is an explanation of the flexibility provided by the workforce flexibility (work-flex) provisions of the regulations.

These resources were developed under the United We Ride initiative. United We Ride is an interagency Federal initiative that supports states and localities in developing coordinated human service delivery systems. In addition to awarding state coordination grants, United We Ride provides state and local agencies a transportation coordination and planning self-assessment tool, technical assistance, and other resources to help communities succeed.

Agenda: A copy of the tentative agenda is attached. Participants: The agenda has been designed for the managers of the lower and higher authority appeals units and the chief appeals clerks and/or appeals administrative staff supervisors of the lower and higher authority appeals units. The primary goal of the meeting is to provide forums for management and administrative staff audiences to exchange ideas and experiences in managing the high level of appeals workloads that have occurred in recent years. The conference will be of interest to unemployment insurance appellate boards and commission members, chief hearing officers responsible for lower authority appellate adjudications, and the chief counsel and chief executive officers of the various higher authority boards and commissions. Meeting Particulars and Inquiries: Travel and per diem costs for SESA participants will have to be paid from available State Fiscal Year 1997 allocations. Additional funds from the Employment and Training Administration are not available for this purpose. Details about the meeting site, costs, and contact persons for additional information are contained in the attached materials. The Oklahoma Employment Security Commission, Board of Review, is hosting this cooperative conference and has graciously agreed to handle the logistics of registration and related matters.
