WASHINGTON – Secretary of Labor Hilda L. Solis today issued the following statement on the November 2011 Employment Situation report released today:

"Our nation's unemployment rate experienced a significant drop to 8.6 percent in November, a full 1.2 percentage points lower than this time last year. Nonfarm payroll employment added 140,000 private sector jobs last month. This means we've added 1.9 million private sector jobs over the past year – an average of 157,000 a month.

WASHINGTON – In commemoration of World AIDS Day, Secretary of Labor Hilda L. Solis released the following statement highlighting the U.S. Department of Labor's ongoing efforts in the global fight against HIV/AIDS:

ARLINGTON, Va. – The U.S. Department of Labor's Mine Safety and Health Administration will begin implementing pre-assessment conferencing procedures in January 2012 to help reduce any backlog of future violations before the Federal Mine Safety and Health Review Commission. Under the procedures in most MSHA districts, a mine operator and miners' representative may request a conference regarding a contested citation or order only after MSHA proposes a penalty assessment, and any settlements require approval by the commission.

SEASONALLY ADJUSTED DATA In the week ending November 26, the advance figure for seasonally adjusted initial claims was 402,000, an increase of 6,000 from the previous week's revised figure of 396,000. The 4-week moving average was 395,750, an increase of 500 from the previous week's revised average of 395,250.

The advance seasonally adjusted insured unemployment rate was 3.0 percent for the week ending November 19, an increase of 0.1 percentage point from the prior week's unrevised rate.

More than 200 women applicants affected; complaint seeks back wages, job opportunities

ARLINGTON, Va. – The U.S. Department of Labor's Mine Safety and Health Administration today announced that eight mines around the country have received letters putting them on notice that each has a potential pattern of violations of mandatory health or safety standards under Section 104(e) of the Federal Mine Safety and Health Act of 1977. The PPOV screening from which these letters resulted represents the second since MSHA established the current criteria and procedures in September 2010.

SPRINGDALE, Ark. — The U.S. Department of Labor's Office of Federal Contract Compliance Programs has filed an administrative complaint against federal contractor Cargill Meat Solutions, alleging that the company systematically discriminated against 4,069 qualified female, white, black, Hispanic and Native American applicants who sought entry-level production jobs at its Springdale facility.

SILVER SPRING, Md - The U.S. Bankruptcy Court for the District of Maryland has approved a global settlement that allows the U.S. Department of Labor to recover $7,968,744 in back wages, fringe benefits and 401(k) plan assets for more than 2,000 security guards formerly employed by USProtect Corp., a defunct Silver Spring company that provided security services for federal buildings across the country.

ARLINGTON, Va. – The U.S. Department of Labor's Mine Safety and Health Administration today announced that federal inspectors issued 226 citations and orders during special impact inspections conducted at eight coal mines and three metal/nonmetal mines last month. The coal mines were issued 145 citations and 18 orders, while the metal/nonmetal operations were issued 51 citations and 12 orders.

SAN FRANCISCO – The U.S. Department of Labor's Occupational Safety and Health Administration has cited Guam International Country Club for 17 alleged workplace safety violations found during an inspection at the club's maintenance shop in Dededo, Guam. Proposed fines total $32,900.

Allegations:  The lawsuit, filed in U.S. district court in Chicago, alleged that Family Care Management and trustee Michael Kaplan, failed to properly administer and terminate the company’s plan, which has prevented qualified participants from obtaining distributions of their individual account balances.

Women denied employment at Santa Fe Springs, Calif., branch to receive back pay and job offers

LOS ANGELES — The U.S. Department of Labor's Office of Federal Contract Compliance Programs has reached an agreement with federal contractor Nishimoto Trading Co. to settle findings of hiring discrimination. In a conciliation agreement with the department, Nishimoto will pay $400,000 in back wages and interest to 71 women who were rejected for sales associate positions at the company's facility in Santa Fe Springs, Calif.

WEEHAWKEN, N.J. – The U.S. Department of Labor has sued Weehawken-based Worldwide Trade Resources Inc. for failing to administer and terminate the defunct company’s 401(k) plan, in violation of the Employee Retirement Income Security Act. As of Jan. 31, the plan had 52 participants and assets totaling $2.2 million, the latest data available.
