References. The Job Training Partnership Act (JTPA) Regulations at 20 CFR Parts 627.455 and 627.904; the Paperwork Reduction Act of 1995 (P.L. 104-13, 44 U.S.C. Chapter 35); Training and Employment Guidance Letters Nos. 4-97 and 2-98; and Training and Employment Information Notices (TEINs) Nos. 12-93, Change 3 and 14-93, Change 2. Background. The Employment and Training Administration (ETA) has placed a high priority on achieving direct electronic reporting capability for all recipients of ETA funds. This is part of a concentrated effort to increase overall accountability for the funds appropriated to ETA and to avoid cost reporting deficiencies in future OIG findings. These efforts are further responsive to OMB imposed requirements under the Paperwork Reduction Act of 1995. In anticipation of complete electronic reporting for the first required reporting quarter under the Workforce Investment Act (WIA) programs, it is imperative that all States transition into the electronic mode for reporting JTPA data, beginning with the quarter ending March 31, 2000. The three reports for which electronic reporting capability will become immediately accessible are the JQSR, the WFFR, and the DWSPR. National Office Preparation. The following steps have been completed or initiated in the National Office (NO) to facilitate in the transition to Web-based electronic reporting directly by the States: A. Menu-driven software containing the data elements required on the JQSR, the WFFR, and the DWSPR has been designed by the Office of Technology and Information Systems (OTIS) and will be accessible to all States via the Internet. B. The current JTPA reporting system, which is in RBase (DOS) and which requires Regional Office (RO) data entry, will be replaced with a new Oracle Web-based system, requiring data entry by the States. The scheduled date to activate the new system and terminate the old is April 28, 2000. NOTE: Data for the quarter ending March 31 MUST be entered into the new system by the States. The old RBase system will NOT accept data for the quarter ending March 31. After April 28, updates or additions to data for quarters ending December 31, 1999, and prior, will be entered by States in the new Web-based system. C. The National Office of Grants and Contract Management (OGCM) will provide Passwords and PINs to all grantees who do not already have them assigned. The individual handling this process in OGCM is Thomas C. Martin at tcmartin@doleta.gov or 202-219-5731, x123. (Respective ROs will coordinate the collection of information necessary for assignment of Passwords and PINs.) State Reporting and Certification Process. The "Instructions for On-line Reporting" contained in the attachment are to be utilized by States to access the reporting Web-site and JTPA forms for submitting data required on the JQSR, the WFFR, and the DWSPR. These instructions contain detailed specifications for data entry and data submittal. The data can be saved temporarily to await signature of the certifying official. The data entry person saves the report temporarily by pressing the submit button WITHOUT entering a PIN number. A confirmation page stating that the report has been saved and is awaiting final signature will be displayed upon successful transmission. A certifying official is required to review the data for accuracy and completeness, prior to entering their assigned PIN and clicking the submit button. When the data has been successfully submitted, a confirmation page stating that the report has been electronically signed will appear. The data will then be accessible for RO review. If the RO identifies omissions or discrepancies in the data, the State will be contacted and advised of such findings. It will then be incumbent upon the State to make any necessary modifications to previously submitted data. (Only the State can enter or change data. Both the RO and the NO will have read only access.) Action Required. The following actions should be taken immediately by the States: A. After April 28, any outstanding data not previously submitted for quarters ending December 31, 1999, and prior, will be entered by States into the new Web-based system. REMINDER: The old RBase system will be cut off on April 28. B. By no later than May 15, utilize the new Web-based system (to be activated April 28) to enter JTPA data for the quarter ending March 31. The attachment provides step by step instructions. C. State Workforce Liaisons are requested to provide this TEIN to all officials within the State who need such information to implement the Internet-based reporting system for JTPA Titles II and III. Inquiries. Questions concerning this TEIN should be directed to your RO representative. A technical contact person in the OTIS is provided in the attachment, as well as NO program staff. Attachment. Background: There has been considerable interest among State Employment Security Agencies (SESAs) in seeing FUTA receipts by State compared to amounts returned to the States in past years. This UIPL provides these data for FY 1995 and includes updated totals for FY 1981-95. The entire series for FY 1981-93 can be found in UIPL 30-95, and the individual State totals for FY 1994 can be found in UIPL 30-95, Change 1. When comparisons are made between FUTA receipts and amounts returned, it is important to recognize that $7.6 billion of the FUTA receipts for FY 1981-87 were used to repay general revenue loans for Federal benefits paid prior to FY 1981. Also, certain items, particularly postage costs and National Activities expenditures, are not reflected in the State data. These items total approximately $2.3 billion for the FY 1981-95 period. Both of these factors serve to reduce the apparent proportion of FUTA receipts returned to States. Action Required: Please distribute to appropriate staff and replace UIPL 30-95, Change 3.

Reference: Public Laws 104-134 (FY/PY 96), 103-333 (FY/PY 95), 103-112 (FY/PY 94) and TEGLs 12-94 dated May 31, 1995, 12-94 Change 1 dated August 20, 1996, and 7-95 dated July 31, 1996. Background: Federal appropriations laws governing the use of specific fiscal year appropriations for a Federal government agency have, from time to time, imposed additional requirements on an agency's internal and external (e.g., grants/contracts) use of funds. Previously, ETA issued TEGLs (referenced above) to inform and provide guidance on specific Fiscal/Program Year 1995 and 1996 appropriation law provisions which the Congress authorized for the JTPA Title II and III programs. In other instances, Congress has mandated some specific requirements that cut across Federal Departments, agencies and programs. Accordingly, ETA has taken action, in many instances, to incorporate some of these appropriation law "General Provisions" into grant or contract agreements. Regardless of whether an agency takes such action on these broadbased provisions, they are applicable where appropriate. In an effort to keep grantees apprised of current appropriation laws which impact a grantee's program operations, ETA is issuing this and subsequent other issuances as needed. This TEGL will focus only on the General Provisions sections of the referenced appropriation laws for FY/PY 1994, 1995 and 1996. Applicability of General Provisions in Subject Laws: (a) P.L. 104-134, Title V, General Provisions (FY/PY 1996) Title V includes Sections 501 through 520. Of these, only Section 506 (Purchase of American-Made Equipment and Products) and Section 507 (Publicity Requirements) appear to be noteworthy and relevant to ETA grantees and their programs. Section 506 requires the Department to provide notice to contractors and grantees that the "sense of Congress" is that all purchase of equipment and products with FY/PY 1996 appropriated funds be, to the extent practical, American-made. This TEGL will fulfill the requirement for the Notice to its State grantees for JTPA and Wagner-Peyser programs. The compliance requirement at Section 506 for the States is self-explanatory. Regarding Section 507 requirements that certain Federal funding information be contained in public documents, grantees are apprised that the requirement is limited to "grantees" under the applicable appropriation. The applicable definition of "grantee" under the JTPA and Wagner-Peyser programs apply, i.e., the State is the "grantee" (to the extent that a State agency or agencies are expending the subject funds). Also, grantees should read carefully the conditions in which the requirement for disclosing financial information in Requests for Proposals is required. For example, the requirement states that certain "program or project" funding information is required. This does not necessarily include disclosure of a specific dollar amount for a specific purchase, procurement, or subgrant solicitation. See specific Section 507 language. (b) P.L. 103-133, Title V, General Provisions (FY/PY 1995) Title V of this appropriation includes fifteen General Provisions. DOL grantee attention is again directed to those DOL "external" requirements such as Section 507 (Purchase of American-made Equipment and Products) and Section 508 (Publicity Requirements). Although not as likely to be relevant to current grantee programs, see also Section 509 (Abortion Prohibition); and Section 511 (Undocumented Immigrants). (c) P.L. 103-112, Title V, General Provisions (FY/PY 1994) Title V of this appropriation includes only nine General Provisions. Of these, Section 507 (Buy American Act Compliance) is especially relevant to current DOL grantee programs. Action: State JTPA and Wagner-Peyser grantees should review the attached excerpts and take necessary action to ensure compliance with the applicable provisions contained in the subject appropriation laws. This includes the distribution of this information to other affected entities.
