The Effect of the Omnibus Trade Act of 2010 on Phasing Out Changes to the Trade Act of 1974 Enacted by the Trade and Globalization Adjustment Assistance Act of 2009

Purpose

Training and Employment Guidance Letter (TEGL) No. 16-10 (issued December 15, 2010) provided guidance to the State Workforce Agencies or agencies designated by Governors as “Cooperating State Agencies” (CSAs) (also jointly referred to as “states”) for phasing out the amendments to the Trade Act of 1974 enacted by the Trade and Globalization Adjustment Assistance Act of 2009 (TGAAA or the 2009 Amendments). This Change 1 updates that guidance by explaining that the Omnibus Trade Act of 2010 (Omnibus Trade Act), enacted subsequent to TEGL No. 16-10 on December 29, 2010, provided a six-week statutory extension for the application of the 2009 Amendments.

Negotiations and Sanctions Guidance for the Workforce Innovation and Opportunity Act (WIOA) Core Programs

Purpose

Through this guidance, the U.S. Departments of Labor and Education (Departments) delineate the process for negotiating levels of performance, as required by section 116(b)(3)(A)(iv) of the Workforce Innovation and Opportunity Act (WIOA). This guidance also provides explanation of the two instances in which a state may be sanctioned for performance failure or for failure to report (section 116(f) of WIOA). Section 116 of WIOA, its implementing regulations, and this guidance govern how the Departments will determine when it is necessary to sanction a state, which is statutorily required by WIOA.

Purpose

Training and Employment Guidance Letter (TEGL) No. 16-10, Change 2, instructs the State Workforce Agencies or agencies designated by Governors as "Cooperating State Agencies" (CSAs) (also jointly referred to as "states") to operate the Trade Adjustment Assistance (TAA) program under the 2002 Amendments, starting February 15, 2011. This guidance requests that states provide updated petition forms starting on that same date, February 15, 2011. Downloadable (paper) and online petition forms that are currently in use will be rendered obsolete as of that date because they do not allow petitioners to request Alternative Trade Adjustment Assistance (ATAA).
