The purpose of this Training and Employment Guidance Letter (TEGL) is to articulate flexibility available for WIA Title I and W-P Act programs that may be helpful for managing Program Year (PY) 2013 sequestration and rescission-related formula funding reductions.

The purpose of this Training and Employment Guidance Letter (TEGL) is twofold. First, the TEGL provides policy guidance and direction regarding the American Recovery and Reinvestment Act of 2009 (“the Recovery Act”) funding for activities authorized under the Workforce Investment Act of 1998 (WIA) and the Wagner-Peyser Act. The second purpose is to provide specific instructions regarding the requirement for states to modify their WIA and Wagner-Peyser Strategic State Plans.

To respond to questions from State Workforce Agencies designated by Governors as “Cooperating State Agencies” (also jointly referred to as “states”) that administer the Trade Adjustment Assistance (TAA) Program, as amended by the TAAEA.

On March 9, 2009, the Employment and Training Administration (ETA) emailed Indian and Native American grantees a letter and Modification Addendum regarding the availability and use of funds under the American Recovery and Reinvestment Act of 2009 (the Recovery Act), and stated that specific guidance would be forthcoming. Accordingly, the purpose of this Training and Employment Guidance Letter (TEGL) is to provide further policy guidance and direction regarding the Recovery Act funding for activities authorized under the WIA, Subtitle D, Section 166, Native American Programs. Through this guidance, ETA is also providing specific instructions about the requirements for Indian and Native American grantees to modify the currently approved two year plan.

To provide the State Workforce Agencies (SWAs) with final funding allotments for the administration of the WOTC program through September 30, 2013.

The purpose of this advisory is to inform the SWAs that the Employment and Training Administration (ETA) is granting an extension period where employers or their representatives can file WOTC certification requests for new hires using the previously OMB-approved June 2007 ETA Forms 9061 or 9062.

To provide State Workforce Agencies or agencies designated by Governors as "Cooperative State Agencies" (CSAs) (also jointly referred to as "states") with the formula methodology the Department of Labor (Department, or We) used to develop the FY 2013 initial allocation, and to describe the process by which states may request TAA program reserve funds. The term "Program Funds," used below, refers to the funds appropriated for states to provide Training, Employment and Case Management Services, Job Search Allowances, and Relocation Allowances, including the State Administration of these benefits and services to trade-affected workers.

To transmit the updated National Farmworker Jobs Program (NFJP) reporting forms and requirements: the Budget Information Summary (BIS) Report (Employment and Training Administration (ETA) Form 9093), the Program Planning Summary (PPS) Report (ETA Form 9094), the Program Status Summary (PSS) Report (ETA Form 9095), the Housing Assistance Summary (HAS) Report (ETA Form 9164), the Workforce Investment Act Standardized Participant Record (WIASPR), and a grant plan narrative.

TEGL 14-08, Change 1 has five purposes:

• To clarify the period of the American Recovery and Reinvestment Act (the Recovery Act) funding availability at the local level for the Workforce Investment Act (WIA) Adult, Dislocated Worker, and Youth programs;
• To address recapture and reallocation of unobligated local WIA Recovery Act funds;
• To change the funds transfer limit between Recovery Act Adult and Dislocated Worker programs from 20 to 30 percent;
• To encourage local areas to serve migrant and farmworker youth with Recovery Act youth formula funds; and
• To announce the location of frequently asked questions and answers on the Employment and Training Administration Web site.

The purpose of this Training and Employment Guidance Letter (TEGL) is to provide program guidance for use of WIA Youth funded activities in PY 2013.
