Hawaiian Landscaping Company Pays $83,192 in Back Wages For Overtime Violations Found by U.S. Department of Labor

HONOLULU, HI – After an investigation by the U.S. Department of Labor’s Wage and Hour Division (WHD), The Miranda Group – a landscaping company based on Kauai, Hawaii – has paid $83,192 to 48 employees to resolve violations of the Fair Labor Standards Act’s (FLSA) overtime requirements.

The WHD investigation found that The Miranda Group paid employees at straight-time rates for overtime hours worked on special weekend projects. The company paid these hours separately and outside of regular payroll, categorizing the payments as bonuses. The employer’s failure to record accurately the time employees worked on weekends also resulted in FLSA recordkeeping violations.

“The U.S. Department of Labor is committed to ensuring that workers get paid all the wages they have legally earned, including overtime,” said Wage and Hour District Director Terence Trotter, in Honolulu, Hawaii. “The Wage and Hour Division will continue to enforce the law so all employers abide by the same rules. We encourage other employers in this industry to use the results of this investigation as an opportunity to review their own pay practices and to avoid violations like those found in this case.”
