Most section 401 grantees have already received their signed grant documents and Notices of Obligation (NOO's), which authorize them to operate title II-B programs for the summer of 1997. On or about July 1, most grantees will receive their title IV-A grant documents and NOO's for PY 1997. Grantees who use the PMS to draw down their JTPA funds will need to use the following subaccount codes to draw down the appropriate funds. Grantees who continue to obtain their funds through the SF-270, Request for Advance or Reimbursement, will not be affected by this bulletin. Action. The subaccount code required to access title II-B funds for the summer of 1997 will be AB. The new subaccount code for PY 1997 title IV-A funds is AC. JTPA section 401 grantees should use these subaccount codes to draw down 1997 funds. Important Reminders. A. All other previously-issued subaccount codes remain the same, including the "split" subaccounts for title II-B funds for the summer of 1993. Grantees are reminded that, when drawing down funds under either title, the oldest remaining funds should be drawn down first, so that as many subaccounts as possible can be "zeroed out." Grantees should pay special attention to those funds expiring on 06/30/97. B. Because all carry-in limits have been officially removed, the only exception to the "First In, First Out" (FIFO) rule is when a grantee is transferring funds between different grants (such as from the 99-1 grant to the B-5 grant) and wishes to leave the exact amount to be transferred (by title) in the appropriate subaccount to facilitate the transfer process. C. Grantees wishing to transfer funds from the 99-1/B-3 grant to the B-5 grant who have not already done so, should submit their transfer modifications to DINAP as soon as p possible, pursuant to the instructions contained in DINAP Bulletin No. 95-12. The Departments of Labor and Education are reserving funds appropriated for FY96 under the School-to-Work Opportunities Act, Public Law 103-239 for a competition for Indian Program Grants authorized under Title II, Subtitle C of the Act. Grants under this competition will be awarded to local partnerships that serve Indian youth and involve Bureau of Indian Affairs (BIA) funded schools. Approximately $750,000 is available for awards as explained in the attached Federal Register Notice. The following implementation grants were awarded in June 1995 and September 1996: Alamo Navajo School Board, New Mexico; Delaware Tribe of Western Oklahoma, Oklahoma; Puyallup Tribe of Indians and Yakama Indian Nation, Washington; and Lac Courte Oreilles, Wisconsin; Chugach School District, Alaska; Tolchii' Kooh Charter School, Arizona; Mille Lacs Band of Ojibwa, Minnesota; University of New Mexico at Gallup, New Mexico; Utah Navajo Development Council, Utah; St. Stephens Indian School, Wyoming. Additionally, four development grants were also awarded to the following organizations in June 1995 and September 1996: Tohono O'Odham High School and Pascua Yaqui Tribe, Arizona; Hannahville Indian Community, Michigan; and St. Stephens Indian School, Wyoming; Independent School District #38, Minnesota; Belcourt School District #7, North Dakota; Milwaukee Area American Indian Manpower, Wisconsin. JTPA regulations at 20 CFR 632.4 provide for the use of either of two sets of data in determining economically disadvantaged persons and program eligibility: the Health and Human Services Poverty Guidelines or the LLSIL. The attached Federal Register Notice (Vol. 62, No. 80) contains updated LLSIL and detailed instructions for their use, effective April 25, 1997. Action. Grantees will use one of the three tables on pages 20207 thru 20209 of the Notice to find their 70 percent LLSIL for a family of four. Those grantees in one of the 25 Metropolitan Statistical Areas will use Table 3; grantees in Alaska or Hawaii will use Table 2; all other grantees will use Table 1. Grantees using Table 1 can find which region they are in by referring to the list on page 20205 and 20206. Grantees using Tables 1 or 2 must also determine if they are in a metro or non-metro area; this information can be obtained from the grantee's State JTPA. Having found the applicable 70 percent LLSIL for a family of four on Tables 1, 2 or 3, the grantee can then find the 70 percent LLSIL for a family larger or smaller than four on Table 4. For example: a grantee in a non-metro area of Arizona is in the West region. On Table 1 its 70 percent LLSIL is $18,850. To find the applicable 70 percent for a family of six, the grantee finds $18,850 in column four of Table 4 and reads across that line to Column six to find $26,020. Grantees should note the disclaimer on page 20206 that the figures in this notice are valid only for eligibility determination under the JTPA and WOTC programs and should not be used for any statistical purposes. DINAP grantees are to disregard the instructions to Governors on page 20206 in the paragraph entitled "Use of These Data." Questions. Reference. 29 CFR Part 98.100 Background. It has come to DINAP's attention that some section 401 grantees encounter participants who have had financial difficulties with previously obtained Federal education grants and/or student loans. This bulletin conveys Departmental policy with regard to the JTPA eligibility of individuals determined by other agencies to be in default on Federal obligations provided to them for educational/training purposes. Policy. Individuals in default on a government (student) loan or grant may be enrolled as a participant under JTPA if two conditions are met: (1) the individual is otherwise eligible for the particular program applied for; and (2) the individual has not been debarred by another Federal agency for fraudulent activities. Individuals, like organizations, are subject to the debarment and suspension procedures at 29 CFR Part 98, and may not receive any "Federal financial and non-financial assistance and benefits under Federal programs and activities" if debarred. Action. Grantees should handle each such case on an individual basis. When appropriate, grantees should encourage and assist the, applicant in resolving the repayment of the amount in default, but are reminded that JTPA funds cannot be used by the grantee to pay fines or penalties directly. If a participant negotiates a repayment agreement with an agency or financial institution, the grantee may deduct the amount(s) of said payments from amounts otherwise accruing to the participant and transmit those payments to the creditor, just as they would for insurance, child support, or other non-Federal obligations authorized by the participant or ordered by a court. The name was approved in order to more accurately reflect the mission of the office and to eliminate any unfortunate mis-impressions associated with the terminology "special targeted." Information. Effective immediately, the new office name is the Office of National Programs (ONP). Action. References. DINAP Bulletin No. 96-15 Background. Bulletin 96-15 outlined the policy and the proposed method of implementation for reallocation of Title IV-A carryover amounts from PY 96 to PY 97 in excess of the former 20% limitation. As part of that implementation method, grant Notices of Obligation (NOOs) to be sent to grantees after the CAP's were signed, on or about July 1, 1997, were only to provide a portion (75%) of total funds allocated to each grantee. However, the NOO's issued for PY 97 included the full amounts allocated. Therefore, the implementation method as previously announced, will have to be revised. Information. The reallocation policy has been revised to have each grantees' carryover status reviewed upon receipt of the PY 1996 Annual Status Report (ASR), which is due 90 days after the end of the program year (September 30, 1997). As stated in the original policy, upon receipt of the ASR, the Department would compare reported expenditures to total funds available to determine if an excess carryover situation exists. Grants that have carryover in excess of 20% of total available funds will have their PY '97 allotments reduced by the amount in excess. The "recaptured" funds will then be reallocated by formula to the NOO's of all grantees who drew down and expended funds in a timely manner in accordance with their plans, and who did not have excess carryover. In order to implement this policy effectively, it is essential that final ASR's be received accurately and on-time. Now that there is semi-annual reporting, and ASR's are not due until 90 days after the end of the program year, section 401 grantees have been allowed twice as much time to complete half as many reports as required by the regulations at 20 CFR 632.41 which state that, "Within 45 days of the end of each quarter, a Native American grantee shall submit to the Chief, DINAP by registered mail, financial and program reports. Accuracy of all reports much be verified by the chief executive officer or financial officer." Action. Grantees must submit required final ASR's for PY '96 on time and certified as accurate AND FINAL by an appropriate grantee official, postmarked by or before September 30, 1997. The figures on the ASR will be used to determine each grantees carryover status. Revised ASR financial data will not be accepted after the 90 day due date. Also, incomplete ASR's or those submitted on incorrect forms will not be accepted. To assist you, a copy of the most recent version of the ASR is attached. See Bulletin 95-11 for instructions on completing the form. You are also encouraged to submit information in the narrative portion of the ASR for use in the next Program Year Report. A suggested format for submission of the narrative is attached. Submission of a narrative as well as the use of the attached narrative format is optional. Effective date. Immediately. Inquiries. Section 401 grantees are currently required to perform an annual physical inventory to be reconciled with the CPMS Inventory Master List. Upon completion grantees must certify that the inventory is correct by submitting form ETA 3-94, Contractor's Inventory Certificate. Additionally, grantees are required to notify the Department of Labor, Property office, when property considered to be excess is no longer needed. Disposition of property is requested by submitting form ETA SF-120, Report of excess personal property. Grantees should be aware that disposition guidance and/or requirements in the OMB circulars have not changed. Definitions. OMB A-110 codified at 29 CFR Part 95.2(ee) states "Property means, unless otherwise stated, equipment, intangible property and debt instruments." 29 CFR Part 95.2(z) states "Personal property means property of any kind except real property. It may be tangible, having physical existence, or intangible, having no physical existence, such as copyrights, patents, or securities". 29 CFR Part 95.2(n) states "Equipment means tangible non-expendable personal property I including exempt property charged directly to the award having a useful life of more than one year and an acquisition cost of $5,000.00 or more per unit. However, consistent with recipient policy, lower limits may be established...." Action. Effective immediately, section 401 grantees will not be required to conduct annual physical inventories to be reconciled to the CPMS with subsequent certifications submitted to the DOL property office. Additionally, section 401 grantees will not be required to receive prior agency approval to dispose of property and equipment with a fair market value less than $5,000.00 per unit. Important Reminders. a. Grantees must receive prior agency approval to purchase property and equipment with an acquisition cost of $5,000.00 or more per unit. b. Grantees must receive prior agency approval to dispose of property and equipment which has a fair market value of $5,000.00 or more at the time of disposition. c. Although property and equipment will not be maintained on the CPMS, grantees must maintain an inventory system which records all equipment information. Equipment information shall include: 1. A description of the equipment. 2. Manufacturer's serial number, model number, Federal stock number, national stock number, or other identification number. 3. Source of the equipment including the award number. 4. Whether title vests in the recipient or the Federal Government. 5. Acquisition date (or date received, if the equipment was furnished by the federal government) and cost. 6. Information from which one can calculate the percentage of Federal participation in the cost of the equipment (not applicable to equipment furnished by the Federal Government). 7. Location and condition of the equipment and the date the information was reported. 8. Unit acquisition cost. 9. Ultimate disposition date, including date of disposal and sales price or the method used to determine current fair market value where a recipient compensates DOL for its share. Effective Date. References. DINAP Bulletin 97-01 Background. DINAP Bulletin 97-01 was issued to all JTPA, Section 401 Indian and Native American Grantees with the intent of providing guidance on the use of JTPA funds for tuition and fees in conjunction with U. S. Department of Education Pell Grants. Due to some confusion created by varying interpretations of DINAP Bulletin 97-01, this bulletin rescinds 97-01. Bulletin 97-08 is intended to clarify any misunderstandings related to the use of JTPA funds in conjunction with Pell Grant awards. Some grantees use JTPA funds to pay for tuition and fees for JTPA, Section 401 program participants to attend vocational/technical schools, community colleges and other higher education institutions. In some cases, the program participant (student) is also awarded a needs-based Pell Grant. Also, in order to secure a participant's enrollment, tuition payments have been paid from JTPA program funds when other types of financial aid applied for, such as Pell Grant funds, have not been received prior to established tuition payment deadlines. Action. Grantees are encouraged to assist participants in applying for all available education financial aid resources, including Pell Grants. In addition, to maximize the use of all resources potentially available to participants, grantees should make every effort to ensure participants have applied for Pell Grants far enough in advance of the beginning of classes. This should hopefully result in assisting JTPA program managers with assessing a participant's unmet needs that can be further supported by the JTPA program beyond those paid for by Pell Grant funds.
