DATE TO ALL INDIAN AND NATIVE AMERICAN GRANTEES FROM BYRON ZUIDEMA s for PORTIA WU A ssistant Secretary SUBJ ECT Native American Employment and Training Council Call for Nominations 1.Purpose. To request nominations for consideration by the Secretary of Labor Thomas E. Perez for appointment to fill the expiring terms of membership on the Native American Employment and Training Council Council by the Workforce Innovation and Opportunity Act WIOA Section 166 grantees. 2.References. Public Law 113-128 of the WIOA section 166 i 4 A . 3. Background. The Council is mandated by WIOA which states that the Secretary shall establish a Native American Employment and Training Council to facilitate the consultation described in Section 166 i 2 and to provide the advice described in Section 166 i 4 C of the statute. The Council is a non-discretionary committee that is operated in accordance with the provisions of the Federal Advisory Committee Act FACA as amended 5 U.S.C. App 2 and implementing regulations 41 CFR 101-6 and 102-3 . The current Council Charter was renewed for two years effective September 11 2015. The Charter provides for the Council to be composed of no less than 15 members but no more than 20 appointed by the Secretary pursuant to WIOA Section 166 i 4 B who are representatives of Indian tribes tribal organizations Alaska Native entities Indian-controlled organizations serving Indians or Native Hawaiian organizations. Excep t as otherwise required by law Council membership will be consistent with the applicable FACA regulations as follows a membership on the Council will be fairly balanced b members will come from a cross-section of those directly affected interested and qualified as appropriate to the nature and functions of the Council and c the composition of the Council will therefore depend upon several factors including i the Council s mission ii the geographic ethnic social economic or scientific impact of the advisory committee s recommendations iii the types of specific perspectives required iv the need to obtain divergent points of view on the issues before the Council such as for example those of consumers technical experts the public at-large academia business or other sectors and v the relevance of State local or tribal governments to the development of the Council s recommendations. To th e extent permitted by FACA and other laws Council membership should also be consistent with achieving the greatest impact scope and credibility among diverse18-15 December 7 2015 2 stakeholders. The diversity in such membership includes but is not limited to race gender disability sexual orientate and gender identity. 4. Action. The Secretary is seeking tribal nominations in the areas of business and entrepreneurship economic development secondary and post-secondary education health care and veteran services to join the Council and provide expertise on the WIOA Indian and Native American Programs. The Secretary also is seeking these representatives for each of the five regions listed below Region II Philadelphia Council member terms are not expiring and other representatives from Other Discipline . Instructions on submitting recommendations follow in this section. Appointments for the following 12 members will expire on April 2 2015 REGION I BOSTON includes CT MA ME NH NJ NY PR RI and VT Mr. Darrell Waldron REGION III ATLANTA includes KY NC TN MS AL SC GA and FL Mr. Elkton Richardson Mr. James Hardin REGION IV DALLAS includes AR CO LA MT ND NM SD TX UT and WY Dr. Rodney Stapp Ms. Kimberly Carroll REGION V CHICAGO includes IA IL IN KS MI MN MO NE OH and WI Ms. Christine Molle REGION VI SAN FRANCISCO includes AK AZ CA GU HI ID NV OR and WA Ms. Lorenda Sanchez Ms. Julia Davis-Wheeler Ms. Roselyn Shirley Ms. Kristen English OTHER DISCIPLINE Dr. David Yarlott Mr. Jacob Bernal In reference to the Other Discipline memberships the FACA regulations at 41 CFR Section 102-3.30 c requires advisory committees to have a balanced membership in terms of the points of view represented and the functions to be performed. Factors to be considered 3 in achieving such a membership depend upon several elements including the vision and mission of the Secretary. Prospective nominees may represent various areas of expertise such as technical experts e.g. businesses entrepreneurships education including tribal colleges health care elected tribal leaders business or other sectors. These individuals as are members of the Council must be representative of Indian tribes tribal organizations Alaska Native entities Indian-controlled organizations serving Indians or Native Hawaiian organizations. In nominating Other Discipline representatives the factors described above must be considered. Members of the Council shall serve at the pleasure of the Secretary for a two-year term designated by the Secretary in writing. The Secretary may consider nominations for appointment to the Council as submitted by the grantee or tribal communities. All members listed above are eligible for nomination. The Department will accept nominations from all grantees to fill seats on the Council representing Other Discipline memberships. Indian tribes and Indian Alaskan Native and Native Hawaiian organizations that do not administer a Section 166 grant may also submit nominations. Public Law 102-477 grantees and tribal officials are also eligible for appointment to the Council. In submitting nominations consideration should be given as to the availability of the nominee to attend and actively participate in Council meetings a minimum of two meetings annually the ability to serve on Council workgroups and provide feedback to the grantee community. Communication between the Council member and his or her constituency is essential to the partnership between the Department and Indian and Native American communities. Members of the Council shall serve without compensation but shall be allowed travel expenses including per diem in lieu of subsistence as authorized by Section 166 i 4 D i and ii of WIOA. The Division of Indian and Native American Programs will accept nominations electronically submitted to Athena Brown Designated Federal Officer DFO at brown.athena dol.gov or by fax at 202 693-3817. A biography resume and acceptance form must be included in the nomination package. In addition include the name and telephone number of the individual who is submitting the nomination.
