Solis v. Glen Zucker complaint involving Grant Saint John 401(k) Profit Sharing Plan in Galion, Ohio

Names of Defendant: Glen Zucker, individually and as a fiduciary to the Grant Saint John 401(k) Profit Sharing Plan; Truprint Services, Inc. d.b.a. Grant Saint John; and Grant Saint John 401(k) Profit Sharing Plan

Allegations: Glen Zucker, individually and as a fiduciary to the Grant Saint John 401(k) Profit Sharing Plan and Truprint Services, Inc. d.b.a. Grant Saint John failed to remit or untimely remitted participant contributions and loan repayments to the Grant Saint John 401(k) Profit Sharing Plan from Jan. 10, 2007, to Jan. 9, 2009. As a result of the unremitted and untimely remitted participant contributions and loan repayments, $8,209.59 is owed to the plan.  The company ceased operations in December 2010.

Resolution: The complaint asks the court to order Glen Zucker to restore all losses to the plan, including lost opportunity costs, resulting from his fiduciary breaches, to administer the termination of the plan, and to permanently bar him from serving as a fiduciary or service provider to any ERISA-covered employee benefit plan following the plan termination.
