U.S. Department of Labor obtains judgment barring officers of defunct Charlotte, NC, employee staffing company from serving as plan fiduciaries

Atlanta - The U.S. Department of Labor has obtained a default judgment barring People Unlimited Consulting Inc. and two of its officers, Janice Love and Linda Marler, from serving in a fiduciary capacity to any employee benefit plan governed by the Employee Retirement Income Security Act (ERISA).

"We are very pleased that the court agreed with the Labor Department that these individuals should never be allowed to serve again as fiduciaries of any ERISA-covered plan," said R.C. Marshall, regional administrator in Atlanta of the department's Employee Benefits Security Administration (EBSA).

The judgment, entered in the U.S. District Court for the Western District of North Carolina in Charlotte, resolves a lawsuit in which the department alleged the defendants failed to distribute assets of the company's 401(k) plan to participants after the company ceased operations.

Since the complaint was filed, the plan has been terminated and participants have received the proceeds. Before it ceased operations, People Unlimited Consulting Inc. was an employee staffing firm specializing in the health care industry.

This case was investigated by EBSA's Atlanta Regional Office. In fiscal year 2009, EBSA achieved monetary results of $1.3 billion related to pension, 401(k), health and other benefits for millions of American workers and their families.
