To provide information and additional guidance about the ETA-9130 Financial Report (9130). This TEGL should be used as a supplemental resource to 9130 financial reporting. The 9130 reporting instructions are the primary sources for detailed instructions to complete the forms. Therefore, this TEGL does not contain information about all sections or line items on the 9130; rather it only covers areas where additional clarification or guidance will help ensure consistent and accurate financial reporting.

To advise State Workforce Agencies (SWAs) of their Foreign Labor Certification (FLC) grant allocations for the first 92 days of the FY 2009 Continuing Resolution (CR) in effect October 1, 2008, through March 6, 2009.

• To provide instructions to states for extending the life of their State Strategic Plans for Title I of the Workforce Investment Act of 1998 (WIA) and the Wagner-Peyser Act (“the State Plan”) for an additional year, through Program Year 2009;
• To provide instructions to states for extending existing waivers and requesting new waivers; and
• To announce renewal of Office of Management and Budget (OMB) approval for Stand-Alone and Unified Strategic State Planning Guidances.

The purpose of this Training and Employment Guidance Letter is to describe common waivers to the Workforce Investment Act of 1998 (WIA) and the Wagner-Peyser Act that may assist states as they develop economic recovery strategies.

To issue the revised Federal poverty guidelines for SCSEP eligibility determinations.

Through this guidance, the Department of Labor is providing instruction on how states can apply for exemptions to restrictions prohibiting the use of OJT NEG funds on activities related to casinos or other gambling establishments, swimming pools, aquariums, zoos, and golf courses. In addition, this guidance provides updated hourly State Wage Cap data. Updated Unemployment Insurance (UI) Duration figures for OJT NEGs are not included in this TEGL, but are updated quarterly on doleta.gov.

To assist State Workforce Agencies (SWAs) or agencies designated by Governors as “Cooperating State Agencies” (CSAs) and States in providing services to TAA program participants through the American Job Center network. This guidance supersedes TEGL No. 5-00, Attachment B, incorporating the changes to the program since the issuance of that TEGL, including the expanded funding source options.

To inform states of the guidelines for negotiating Workforce Investment Act (WIA) Title IB performance and customer satisfaction goals and performance levels for the Wagner-Peyser Act funded activities for Program Year (PY) 2009, including the option to extend PY 2008 negotiated goals for PY 2009. These performance goals, once they are agreed upon between the state and the Employment and Training Administration (ETA), will be incorporated into the State’s Strategic Plan for the WIA and Wagner-Peyser Act.

To provide guidance to State Workforce Agencies (SWAs) on the responsibilities of serving migrant and seasonal farm workers (MSFWs) through the American Job Center (also known as One-Stop Career Center) network and on the responsibilities of the State Monitor Advocates (SMAs).

To inform states of the extended timeline for the collection of data on the provision of intensive services to Post-9/11 Era Veterans through the Wagner-Peyser Employment Service under the Gold Card Initiative.
