Determinations Regarding Eligibility
To Apply for Worker Adjustment Assistance

In accordance with Section 223 of the Trade Act of 1974, as
amended ("Act"), 19 U.S.C. § 2273, the Department of Labor
herein presents the results of an investigation regarding
certification of eligibility to apply for worker adjustment
assistance.
The group eligibility requirements for workers of a firm
under Section 222(a) of the Act, 19 U.S.C. § 2272(a), are
satisfied if the following criteria are met:
(1) a significant number or proportion of the workers in such
workers' firm have become totally or partially separated, or
are threatened to become totally or partially separated; and
(2)(A)(i) the sales or production, or both, of such firm have
decreased absolutely; and
(ii)(I) imports of articles or services like or directly
competitive with articles produced or services supplied by
such firm have increased; and
(iii) the increase in imports described in clause (ii)
contributed importantly to such workers' separation or
threat of separation and to the decline in the sales or
production of such firm.

"Group means three of more workers in a firm or
appropriate subdivision thereof." "Significant number or
proportion of the workers means . . . At least three workers
in a firm (or appropriate subdivision thereof) with a work
force fewer than 50 workers." 29 CFR 90.2
The investigation was initiated in response to a petition
filed on March 5, 2018, by the United Food and Commercial
Workers (UFCW), Local 21, on behalf of workers of Grays Harbor
Community Hospital, Health Information Management (Medical
Records) Division, Medical Coder Unit, governed by Grays
Harbor Public Hospital, District #2, Aberdeen, Washington (TA-
W-93,602), Grays Harbor Community Hospital, Patient Accounts
Department, Billing Unit, governed by Grays Harbor Public
Hospital, District #2, Aberdeen, Washington (TA-W-93,602A),
and Grays Harbor Community Hospital, Health Information
Management (Medical Record) Division, Transcription Unit,
governed by Grays Harbor Public Hospital, District #2,
Aberdeen, Washington (TA-W-93,602B). The petition alleges that
outsourcing of medical coding, billing, and transcription
services resulted in worker group separations at Grays Harbor
Community Hospital, Aberdeen, Washington.
Workers of Grays Harbor Community Hospital, Health
Information Management (Medical Record) Division, Medical
Coding Unit, Aberdeen, Washington are engaged in activities
related to the supply of medical coding services. Workers of
Grays Harbor Community Hospital, Health Information Management
(Medical Record) Division, Transcription Unit, Aberdeen,
Washington are engaged in activities related to the supply of
transcription services. Workers of Grays Harbor Community
Hospital, Patient Accounts Department, Billing Unit, Aberdeen,
Washington are engaged in activity related to the supply of
billing services.
The worker group at Grays Harbor Community Hospital,
Health Information Management (Medical Records) Division,
Medical Coder Unit, Aberdeen, Washington (TA-W-93,602) includes
on-site leased workers from Accountable Healthcare Nursing,
Advance Medical Personal Services, Advantage RN, Allcare
Medical Services, AMN Healthcare, Anders Group, Aureus
Cardiopulmonary, Axis Provider Inc., Aya Healthcare, Cariant
Health Partners, Cell Staff LLC, Continuum Medical Staffing,
Genisis Medical Staffing/Elite Medical, HCTec Partners,
Integrated Healthcare Solutions, LLC, LRS Healthcare, Maxim
Staffing Solutions, Medical Staffing Solutions, Medpro
Staffing, National Staffing Solutions, Newworx Health,
Nightingale Nurses, Onestaff Medical, Platinum Enterprise
Solutions, Professional Placement Resources/PPR Talent
Management Group, Randstad Healthcare, R Visions LLC, Soiliant

During the course of the investigation, information was
collected from the petitioner and the workers' firm.

The investigation revealed that workers of Grays Harbor
Community Hospital, Health Information Management (Medical
Records) Division, Medical Coder Unit, Aberdeen, Washington
(Medical Coder Unit) meet the criteria for certification.
Section 222(a)(1) has been met because a significant
number or proportion of the workers in the Medical Coder Unit
have become totally or partially separated, or are threatened to
become totally or partially separated.
Section 222(a)(2)(B) has been met because the workers'
firm has acquired from a foreign country the supply of services
like or directly competitive with the medical coding services
supplied by the subject workers which contributed importantly to
worker group separations at the Medical Coder Unit.

The investigation revealed that workers of Grays Harbor
Community Hospital, Patient Accounts Department, Billing Unit,
Aberdeen, Washington (Billing Unit) meet the criteria for
certification.
Section 222(a)(1) has been met because a significant
number or proportion of the workers in the Billing Unit have
become totally or partially separated, or are threatened to
become totally or partially separated.
Section 222(a)(2)(B) has been met because the workers'
firm has acquired from a foreign country the supply of services
like or directly competitive with the billing services supplied
by the subject workers which contributed importantly to worker
group separations at the Billing Unit.

The investigation revealed that workers of Grays Harbor
Community Hospital, Health Information Management (Medical
Record) Division, Transcription Unit, Aberdeen, Washington do
not meet the criteria for certification.
The worker group of Grays Harbor Community Hospital,
Health Information Management (Medical Record) Division,
Transcription Unit, Aberdeen, Washington consists of fewer
than three workers. Consequently, neither the statutory nor
the regulatory criteria regarding worker group and significant
number or proportion the worker group have been met.
Conclusion
After careful review of the facts obtained in the
investigation, I determine that, with regards to the worker
group covered by TA-W-93,602B, the requirements of Section 222
of the Act, 19 U.S.C. § 2272, have not been met and, therefore,
deny the petition for group eligibility of Grays Harbor
Community Hospital, Health Information Management (Medical
Record) Division, Transcription Unit, governed by Grays Harbor
Public Hospital, District #2, Aberdeen, Washington, to apply
for adjustment assistance, in accordance with Section 223 of the
Act, 19 U.S.C. § 2273.
After careful review of the facts obtained in the
investigation, I determine that workers of Grays Harbor
Community Hospital, Health Information Management (Medical
Records) Division, Medical Coder Unit, Aberdeen, Washington
and Grays Harbor Community Hospital, Patient Accounts
Department, Billing Unit, Aberdeen, Washington, meet the worker
group certification criteria under Section 222(a) of the Act, 19
U.S.C. § 2272(a), in accordance with Section 223 of the Act, 19
U.S.C. § 2273. In accordance with Section 223 of the Act, 19
U.S.C. § 2273, I make the following certification:
"All workers of Grays Harbor Community Hospital, Health
Information Management (Medical Records) Division,
Medical Coder Unit, governed by Grays Harbor Public
Hospital, District #2, including on-site leased workers
from Accountable Healthcare Nursing, Advance Medical
Personal Services, Advantage RN, Allcare Medical
Services, AMN Healthcare, Anders Group, Aureus
Cardiopulmonary, Axis Provider Inc., Aya Healthcare,
Cariant Health Partners, Cell Staff LLC, Continuum
Medical Staffing, Genisis Medical Staffing/Elite Medical,
HCTec Partners, Integrated Healthcare Solutions, LLC, LRS
Healthcare, Maxim Staffing Solutions, Medical Staffing
Solutions, Medpro Staffing, National Staffing Solutions,

totally or partially separated from employment on or after
February 26, 2017 through two years from the date of
certification, and all workers in the group threatened with
total or partial separation from employment on the date of
certification through two years from the date of
certification, are eligible to apply for adjustment
assistance under Chapter 2 of Title II of the Trade Act of
1974, as amended."
