Certification Regarding Eligibility to Apply for
Worker Adjustment Assistance

In accordance with Section 223 of the Trade Act of 1974 (19 USC
2273), as amended, the Department of Labor herein presents the
results of an investigation regarding certification of eligibility
to apply for worker adjustment assistance as a secondarily affected
worker group.
The investigation was initiated on November 24, 2004 in
response to a petition filed on behalf of workers at A & W Screen
Printing, Inc., Ephrata, Pennsylvania. The workers of the subject
firm were engaged in silk screen printing for apparel.
The investigation further revealed that leased workers of
Advance Personnel, Berks & Beyond Employment, Mack Employment
Services, Inc., Business Staffing & Employment Services, Spherion
and Gage Personal produced silk screens at A & W Screen Printing,
Inc., Ephrata, Pennsylvania.
The investigation revealed that sales and production
employment at the subject firm decreased from 2002 to 2003 and
again during the period of January through November 2004 compared
to the same period in 2003.
The investigation revealed that the subject firm supplied silk
screen printing used in the production of shirts, and a loss of
business with a manufacturer (whose workers were certified eligible
to apply for adjustment assistance) contributed importantly to the
workers separation or threat of separation.
Conclusion
After careful review of the facts obtained in the
investigation, I determine that workers of A & W Screen Printing,
Inc., Ephrata, Pennsylvania qualify as adversely affected secondary
workers under Section 222 of the Trade Act of 1974, as amended. In
accordance with the provisions of the Act, I make the following
certification:
"All workers of A & W Screen Printing, Inc., Ephrata,
Pennsylvania including lease workers of Advance Personnel,
Berks & Beyond Employment, Mack Employment Services, Inc.,
Business Staffing & Employment Services, Spherion and Gage
Personal, who became totally or partially separated from
employment on or after November 18, 2003, through two years
from the date of certification are eligible to apply for
adjustment assistance under Section 223 of the Trade Act of
1974."
