Amended Certification Regarding Eligibility
To Apply for Worker Adjustment Assistance
In accordance with Section 223 of the Trade Act of 1974 (19
USC 2273), as amended, the Department of Labor issued a
Certification of Eligibility to Apply for Worker Adjustment
Assistance on November 1, 2004, applicable to workers of Bombardier
Transportation, a subsidiary of Bombardier, Inc., Propulsion
Division, Pittsburgh, Pennsylvania. The notice will be published
soon in the Federal Register.
At the request of the State agency, the Department reviewed
the certification for workers of the subject firm. The workers are
engaged in the production of propulsion equipment.
New information shows that there was a previous certification,
TA-W-41,025, issued on June 21, 2002, for workers of Bombardier
Transportation, a subsidiary of Bombardier, Inc., Propulsion
Division, Pittsburgh, Pennsylvania who were engaged in employment
related to the production of propulsion equipment. That
certification expired June 21, 2004. To avoid an overlap in worker
group coverage, the certification is being amended to change the
impact date from September 8, 2003 to June 22, 2004, for workers of
the subject firm.
The amended notice applicable to TA-W-55,656 is hereby issued
as follows:
“All workers of Bombardier Transportation, a subsidiary of
Bombardier, Inc., Propulsion Division, Pittsburgh,
Pennsylvania (TA-W-55,656), who became totally or
Partially separated from employment on or after June 22,
2004, through November 1, 2006, are eligible to apply for
adjustment assistance under Section 223 of the Trade Act of
1974."

Certification Regarding Eligibility
To Apply for Worker Adjustment Assistance
In accordance with Section 223 of the Trade Act of 1974 (19
USC 2273), the Department of Labor herein presents the results of
its investigation regarding certification of eligibility to apply
for worker adjustment assistance.
In order to make an affirmative determination and issue a
certification of eligibility to apply for Trade Adjustment
Assistance, the group eligibility requirements in either paragraph
(a)(2)(A) or (a)(2)(B) of Section 222 of the Trade Act must be met.
With regards to workers at Bombardier Transportation,
Propulsion Division, and Bombardier Transportation, TTS Division,
it is determined in this case that the requirements of (a)(2)(A) of
Section 222 have been met.
The investigation was initiated on September 23, 2004 in
response to a petition filed by a company official on behalf of
workers of Bombardier Transportation, a subsidiary of Bombardier,
Inc., Propulsion Division (TA-W-55,656), and Total Transit Systems
Division (TTS) (TA-W-55,656A), both located in Pittsburgh,
Pennsylvania. The workers in the Propulsion Division are engaged
in the production of propulsion equipment; those in the Automated
Transit Systems Division produce automated transit systems.
With respect to both the Propulsion Division and the TTS
Division, the investigation revealed that employment and sales
decreased in January through August 2004 compared to the same
period in 2003.
The Department of Labor surveyed entities to which both
Divisions had submitted bids for major contracts in the United
States. The survey revealed that the subject firm lost contracts to
foreign sources and was the lowest domestic bidder in these cases.
Conclusion
After careful review of the facts obtained in the
investigation, I determine that increases of imports of articles
like or directly competitive with propulsion equipment and
automated transit system produced at Bombardier Transportation,
Propulsion Division and TTS Division, Pittsburgh, Pennsylvania,
contributed importantly to the total or partial separation of
workers and to the decline in sales or production at that firm or
subdivision. In accordance with the provisions of the Act, I make
the following certification:
"All workers of Bombardier Transportation, a subsidiary of
Bombardier, Inc., Propulsion Division, Pittsburgh,
Pennsylvania (TA-W-55,656), and Bombardier Transportation, a
subsidiary of Bombardier, Inc., TTS Division, Pittsburgh,
Pennsylvania (TA-W-55,565A), who became totally or partially
separated from employment on or after September 8, 2003,
through two years from the date of certification are eligible
to apply for adjustment assistance under Section 223 of the
Trade Act of 1974."
