Amended Certification Regarding Eligibility to
Apply for Worker Adjustment Assistance

In accordance with Section 223 of the Trade Act of 1974 (19
USC 2273) the Department of Labor issued a Certification of
Eligibility to Apply for Worker Adjustment Assistance on October
1, 2002, applicable to workers of Unilever Best Foods North
America, Santa Cruz, California. The notice was published in the
Federal Register on October 22, 2002 (67 FR 64923).
At the request of the State agency, the Department reviewed
the certification for workers of the subject firm. The workers
were engaged in the production of packaged tea, including black
tea and herbal tea.
New information shows that that some workers separated from
employment at the subject firm had their wages reported under a
separate unemployment insurance (UI) tax account for Conopco.


Accordingly, the Department is amending the certification to
properly reflect this matter.


The intent of the Department’s certification is to include
all workers of Unilever Best Foods North America, Santa Cruz,
California who were adversely affected by increased imports.
The amended notice applicable to TA-W-41,918 is hereby
issued as follows:
"All workers of Unilever Best Foods North America,
Conopco, Santa Cruz, California, who became totally or
partially separated from employment on or after July
24, 2001, through October 1, 2004, are eligible to
apply for adjustment assistance under Section 223 of
the Trade Act of 1974."

Certification Regarding Eligibility
To Apply for Worker Adjustment Assistance

In accordance with Section 223 of the Trade Act of 1974 (19
USC 2273) as amended by the Omnibus Trade and Competitiveness Act
of 1988 (P. L. 100-418), the Department of Labor herein presents
the results of an investigation regarding certification of eligi-
bility to apply for worker adjustment assistance.
In order to make an affirmative determination and issue a
certification of eligibility to apply for adjustment assistance
each of the group eligibility requirements of Section 222 of the
Act must be met. It is determined in this case that all of the
requirements have been met.
The investigation was initiated on August 5, 2002, in response
to a petition filed on behalf of workers at Unilever Best Foods
North America, Santa Cruz, California. The workers are engaged in
work related to the production of packaged tea, including black tea
and herbal tea. There is no separation by product line.
The investigation revealed that production and employment at
the subject facility decreased during the period under
investigation.


The investigation further revealed that the Unilever
Bestfoods North America is replacing a portion of packaged tea
produced at the Santa Cruz facility with packaged black tea
produced abroad to supply U.S. customers.
United States aggregate imports of black tea (fermented) and
partly fermented tea, in immediate packings of a content not
exceeding 3 kilograms, increased significantly in January through
June 2002 compared with the same period one year earlier.
Conclusion
After careful review of the facts obtained in the
investigation, I conclude that increases of imports of articles
like or directly competitive with those produced by Unilever Best
Foods North America, Santa Cruz, California, contributed
importantly to the decline in sales or production and to the total
or partial separation of workers of that firm. In accordance with
the provisions of the Trade Act, I make the following
certification:



"All workers at Unilever Best Foods North America, Santa Cruz,
California, who became totally or partially separated from
employment on or after July 24, 2001, through two years from
the date of certification, are eligible to apply for
adjustment assistance under Section 223 of the Trade Act of
1974."
