Amended Certification Regarding Eligibility to
Apply for Worker Adjustment Assistance

In accordance with Section 223 of the Trade Act of 1974 (19
USC 2273) the Department of Labor issued a Certification of
Eligibility to Apply for Worker Adjustment Assistance on December
2, 2002, applicable to workers of Emess Design Group, LLC,
located in Ellwood City, Pennsylvania. The notice was published
in the Federal Register on December 23, 2002 (67 FR 78256).
At the request of the company, the Department reviewed the
certification for workers of the subject firm. The workers
produce lamps and lamp products. Information provided by company
shows that on April 12, 2002, Emess Design Group, LLC, purchased
the assets of another company.
Since the Emess Design Group, LLC did not exist prior to
April 12, 2002, the Department is changing the impact date from
July 15, 2001 to April 12, 2002.
The amended notice applicable to TA-W-41,916 is hereby
issued as follows:


"All workers of Emess Design Group, LLC, Ellwood City,
Pennsylvania, who became totally or partially separated from
employment on or after April 12, 2002 through December 2,
2004, are eligible to apply for adjustment assistance under
Section 223 of the Trade Act of 1974.”

Certification Regarding Eligibility
To Apply for Worker Adjustment Assistance

In accordance with Section 223 of the Trade Act of 1974 (19
USC 2273) as amended by the Omnibus Trade and Competitiveness Act
of 1988 (P. L. 100-418), the Department of Labor herein presents
the results of an investigation regarding certification of eligi-
bility to apply for worker adjustment assistance.
In order to make an affirmative determination and issue a
certification of eligibility to apply for adjustment assistance
each of the group eligibility requirements of Section 222 of the
Act must be met. It is determined in this case that all of the
requirements have been met.
The investigation was initiated in response to a petition
received on August 5, 2002, and filed by the American Flint Glass
Workers Union on behalf of workers at Emess Design Group, LLC,
Ellwood City, Pennsylvania. The workers are engaged in the
production of lamps and lamp products.
The investigation revealed that sales, production, and
employment at the subject firm declined to zero as the plant shut
down in September of 2002.


The U.S. Department of Labor conducted a survey of major
customers of Emess Design Group, LLC, Ellwood City, Pennsylvania,
regarding their purchases of lamps and lamp products during 2000-
2001 and January to July, 2001-2002. The survey revealed that a
respondent reported increasing imports of lamps and lamp
products, while decreasing purchases from the subject firm.
Conclusion
After careful review of the facts obtained in the investi-
gation, I conclude that increased imports of articles like or
directly competitive with the lamps and lamp products produced at
Emess Design Group, LLC, Ellwood City, Pennsylvania contributed
importantly to the decline in sales or production and to the
total or partial separation of workers of that firm.
In accordance with the provisions of the Act, I make the
following certification:
"All workers of Emess Design Group, LLC, Ellwood City,
Pennsylvania, who became totally or partially separated from
employment on or after July 15, 2001, through two years from
the date of certification are eligible to apply for
adjustment assistance under Section 223 of the Trade Act of
1974."
