Amended Certification Regarding Eligibility to
Apply for Worker Adjustment Assistance
In accordance with Section 223 of the Trade Act of 1974 (19
USC 2273) the Department of Labor issued a Certification of
Eligibility to Apply for Worker Adjustment Assistance on October
10, 2002, applicable to workers of TNS Mills, Inc., Gaffney
Weaving Division, Gaffney, South Carolina. The notice was
published in the Federal Register on November 5, 2002 (67 FR
67422).
At the request of the petitioners, the Department reviewed
the certification for workers of the subject firm. The workers
are engaged in the production of greige goods and yarn.
New information shows that Wellstone Mills, LLC purchased
TNS Mills, Inc., Gaffney Weaving Division, Gaffney, South
Carolina in March 2003 and is now known as Wellstone Mills, LLC.
Workers separated from employment at the subject firm had their
wages reported under a separate unemployment insurance (UI) tax
account for Wellstone Mills, LLC.
Accordingly, the Department is amending the certification to
properly reflect this matter.
The intent of the Department’s certification is to include
all workers of TNS Mills, Inc., Gaffney Weaving Division,
Gaffney, South Carolina who were adversely affected by increased
imports.
The amended notice applicable to TA-W-41,658 is hereby
issued as follows:
"All workers of TNS Mills, Inc., Gaffney Weaving
Division, now known as Wellstone Mills, LLC, Gaffney,
South Carolina, who became totally or partially
separated from employment on or after May 10, 2001,
through October 10, 2004, are eligible to apply for
adjustment assistance under Section 223 of the Trade
Act of 1974."

Certification Regarding Eligibility
To Apply for Worker Adjustment Assistance
In accordance with Section 223 of the Trade Act of 1974 (19
USC 2273) as amended by the Omnibus Trade and Competitiveness Act
of 1988 (P. L. 100-418), the Department of Labor herein presents
the results of an investigation regarding certification of eligi-
bility to apply for worker adjustment assistance.
In order to make an affirmative determination and issue a
certification of eligibility to apply for adjustment assistance
each of the group eligibility requirements of Section 222 of the
Act must be met. It is determined in this case that all of the
requirements have been met.
The investigation was initiated on June 17, 2002, in
response to a petition filed on behalf of workers at TNS Mills,
Inc., Gaddney Weaving Division, Gaffney, South Carolina. The
workers were engaged in employment related to the production of
bottom weight cotton-rich fabrics (greige goods) used in apparel.
This investigation revealed that production and employment
at the subject plant decreased during the period under
investigation as the plant shut down in September of 2001.
The Department of Labor surveyed major customers of the
subject firm regarding their purchases of bottom weight cotton-
rich fabrics (greige goods) in the 2000-2001.
Respondents indicated that they reduced purchases from the
subject firm and either increased imports absolutely or increased
their reliance on imports in the relevant periods.
United States aggregate imports of cotton twill and sateen
fabrics increased relative to U.S. manufacturers’ shipments in
2001 compared with 2000.
Conclusion
After careful review of the facts obtained in the investi-
gation, I conclude that increases of imports of articles like or
directly competitive with those produced by TNS Mills, Inc.,
Gaddney Weaving Division, Gaffney, South Carolina, contributed
importantly to the decline in sales or production and to the
total or partial separation of workers of that firm. In
accordance with the provisions of the Trade Act, I make the
following certification:
"All workers at TNS Mills, Inc., Gaddney Weaving Division,
Gaffney, South Carolina, who became totally or partially
separated from employment on or after may 10, 2001, through
two years from the date of certification, are eligible to
apply for adjustment assistance under Section 223 of the
Trade Act of 1974."
