Amended Certification Regarding Eligibility to
Apply for Worker Adjustment Assistance

In accordance with Section 223 of the Trade Act of 1974 (19
USC 2273) the Department of Labor issued a Certification of
Eligibility to Apply for Worker Adjustment Assistance on August
22, 2002, applicable to workers of Deckerville Wire Company, a
subsidiary of Clements Manufacturing LLC, Harbor Beach, Michigan
and Brown City Wire Company, a subsidiary of Clements
Manufacturing LLC, Harbor Beach, Michigan. The notice was
published in the Federal Register on September 10, 2002 (67 FR
57456).
At the request of the State agency, the Department reviewed
the certification for workers of the subject firm. The workers
produce automobile wire harnesses.
The company reports that in January, 2004, employees of
Deckerville Wire Company and Brown City Wire Company became
employees of ADP TotalSource and that worker wages are reported
under the Unemployment Insurance tax accounts for Deckerville
Wire Company, ADP TotalSource and Deckerville Wire Company, ADP
TotalSource.
Accordingly, the Department is amending the certification to
reflect this matter.
The intent of the Department’s certification is to include
all workers of the subject firms adversely affected by increased
imports.
The amended notice applicable to TA-W-41,645B and
TA-W-41,645C are hereby issued as follows:
"All workers of Deckerville Wire Company, ADP TotalSource,
Harbor Beach, Michigan, a subsidiary of Clements
Manufacturing, headquartered in Sterling Heights, Michigan
TA-W-41,645B and Brown City Wire Company, ADP TotalSource,
Harbor Beach, Michigan a subsidiary of Clements
Manufacturing, headquartered in Sterling Heights, Michigan
(TA-W-41,465C), who became totally or partially separated
from employment on or after May 15, 2001, through August 22,
2004, are eligible to apply for adjustment assistance under
Section 223 of the Trade Act of 1974."

Certification Regarding Eligibility
to Apply for Worker Adjustment Assistance

In accordance with Section 223 of the Trade Act of 1974 (19
USC 2273) as amended by the Omnibus Trade and Competitiveness Act
of 1988 (P. L. 100-418), the Department of Labor herein presents
the results of an investigation regarding certification of eli-
gibility to apply for worker adjustment assistance.
In order to make an affirmative determination and issue a
certification of eligibility to apply for adjustment assistance
each of the group eligibility requirements of Section 222 of the
Act must be met. It is determined in this case that all of the
requirements have been met.
The investigation was initiated in response to a petition
received on June 17, 2002, filed by the company on behalf of
workers at Deckerville Wiring Company, Deckerville and Harbor
Beach, Michigan, and Brown City Wiring Company, Deckerville and
Harbor Beach, Michigan, both wholly owned subsidiaries of Clements
Manufacturing L.L.C., headquartered in Sterling Heights, Michigan.
The workers produced automobile wiring harnesses.
Investigation findings revealed that the subject plants
experienced declines in sales, production, and levels of
employment.
The investigation also showed that the subject firm has
increased its imports of automobile wiring harnesses during the
relevant period.
A petition for NAFTA Transitional Adjustment Assistance has
been filed by the companies on behalf of workers at the subject
facilities (NAFTA-6208). A determination on that petition will be
made concurrently with this determination.
Conclusion


After careful review of the facts obtained in the investi-
gation, I conclude that increases of imports of articles like or
directly competitive with those produced by Deckerville Wiring
Company, Deckerville and Harbor Beach, Michigan, and Brown City
Wiring Company, Deckerville and Harbor Beach, Michigan,
subsidiaries of Clements Manufacturing L.L.C., contributed
importantly to the decline in sales and production and to the total
or partial separation of workers of the subject firm. In
accordance with the provisions of the Act, I make the following
certification:


"All workers at Deckerville Wiring Company, Deckerville
and Harbor Beach, Michigan, and Brown City Wiring
Company, Deckerville and Harbor Beach, Michigan,
(subsidiaries of Clements Manufacturing L.L.C.,
headquartered in Sterling Heights, Michigan), who became
totally or partially separated from employment on or
after May 15, 2001, through two years from the date of
certification, are eligible to apply for adjustment
assistance under Section 223 of the Trade Act of 1974.”
