Notice of Determinations Regarding Eligibility
to Apply for Worker Adjustment Assistance
In accordance with Section 223 of the Trade Act of 1974 (19
USC 2273) as amended by the Omnibus Trade and Competitiveness Act
of 1988 (P. L. 100-418), the Department of Labor herein presents
the results of an investigation regarding certification of eli-
gibility to apply for worker adjustment assistance.
In order to make an affirmative determination and issue a
certification of eligibility to apply for adjustment assistance
each of the group eligibility requirements of Section 222 of the
Act must be met:
(1) that a significant number or proportion of the workers in
the workers' firm, or an appropriate subdivision thereof,
have become totally or partially separated, or are
threatened to become totally or partially separated;
(2) that sales or production, or both, of the firm or subdi-
vision have decreased absolutely; and
(3) that increases of imports of articles like or directly
competitive with articles produced by the firm or appro-
priate subdivision have contributed importantly to the
separations, or threat thereof, and to the absolute
decline in sales or production.
The investigation was initiated in response to a petition
received on June 3, 2002, filed by the company on behalf of workers
at Dimon Incorporated, manufacturing plants in Danville, Virginia,
and Farmville, Greenville, and Kinston, North Carolina, and the
corporate office, Danville, Virginia. The workers were involved in
activities relating to the stemming, packing, processing and
delivery of leaf tobacco.
It has been determined with respect to workers at the
manufacturing plants in Danville, Virginia, and Farmville, North
Carolina, and at the corporate headquarters in Danville, Virginia,
that all of the criteria have been met.
Investigation findings revealed that the Danville and
Farmville manufacturing plants experienced declines in sales and
employment, while the related corporate office in Danville
experienced declines in levels of employment.
The investigation also revealed that the subject firm
increased its imports of leaf tobacco products in calendar year
2001 compared with calendar year 2000.
The investigation also revealed that United States imports of
tobacco products like and directly competitive with those produced
by the subject firm increased substantially during the first five
months of 2002 as compared with the same time period in 2001.
It has been determined with respect to workers of the
manufacturing plants in Greenville and Kinston, North Carolina,
that those two plants have been closed since 1999. Production at
those plants must have occurred one year prior to the date of the
petition to meet the eligibility requirements of the Trade Act of
1974.
Conclusion
After careful review of the facts obtained in the investi-
gation, I conclude that increases of imports of articles like or
directly competitive with those produced by Dimon Incorporated,
manufacturing plants in Danville, Virginia, and Farmville, North
Carolina, and corporate headquarters in Danville, Virginia,
contributed importantly to the decline in sales and to the total or
partial separation of workers of the subject firm. In accordance
with the provisions of the Act, I make the following certification:
"All workers at Dimon Incorporated, manufacturing plants,
Danville, Virginia (TA-W-41,601), and Farmville, North
Carolina (TA-W-41,601B), and corporate headquarters,
Danville, Virginia (TA-W-41,601-A), who were involved in
activities relating to the stemming, packing, processing
and delivery of leaf tobacco and who became totally or
partially separated from employment on or after May 23,
2001, through two years from the date of certification,
are eligible to apply for adjustment assistance under
Section 223 of the Trade Act of 1974."
I further determine that all workers of Dimon Incorporated,
Kinston (TA-W-41,601D) and Greenville, North Carolina (TA-W-
41,601C), are denied eligibility to apply for adjustment
assistance under Section 223 of the Trade Act of 1974.
