Notice of Revised Determination
on Reconsideration

On August 12, 2002, the Department issued an Affirmative
Determination Regarding Application on Reconsideration applicable
to workers and former workers of the subject firm. The notice
was published in the Federal Register on August 20, 2002 (67 FR
53973).
The Department initially denied TAA to workers of Ruger
Equipment, Inc., Urichsville, Ohio engaged in the production of
load lifting and material handling equipment because the
"contributed importantly" group eligibility requirement of
Section 222(3) of the Trade Act of 1974, as amended, was not met.
On reconsideration, the Department conducted a survey of the
major customers of the subject firm regarding their purchases of
load lifting and material handling equipment during the relevant
period. The survey revealed that a major customer increased
their imports, while decreasing their purchases from the subject
firm during the relevant period.





Conclusion
After careful review of the additional facts obtained on
reconsideration, I conclude that increased imports of articles
like or directly competitive with load lifting and material
handling equipment, contributed importantly to the declines in
sales or production and to the total or partial separation of
workers of Ruger Equipment, Inc., Urichsville, Ohio. In
accordance with the provisions of the Act, I make the following
certification:
"All workers of Ruger Equipment, Inc., Urichsville, Ohio who
became totally or partially separated from employment on or
after April 1, 2001 through two years from date of
certification are eligible to apply for adjustment
assistance under Section 223 of the Trade Act of 1974."

Negative Determination Regarding Eligibility
To Apply for Worker Adjustment Assistance

In accordance with Section 223 of the Trade Act of 1974 (19
USC 2273) as amended by the Omnibus Trade and Competitiveness Act
of 1988 (P. L. 100-418), the Department of Labor herein presents
the results of an investigation regarding certification of
eligibility to apply for worker adjustment assistance.
In order to make an affirmative determination and issue a
certification of eligibility to apply for adjustment assistance,
each of the group eligibility requirements of Section 222 of the
Act must be met:
(1) that a significant number or proportion of the workers in
the workers' firm, or an appropriate subdivision thereof,
have become totally or partially separated, or are
threatened to become totally or partially separated;

(2) that sales or production, or both, of the firm or
subdivision have decreased absolutely; and

(3) that increases of imports of articles like or directly
competitive with articles produced by the firm or
appropriate subdivision have contributed importantly to
the separations, or threat thereof, and to the absolute
decline in sales or production.

The investigation was initiated on May 6, 2002 in response to
a petition filed by United Steelworkers of America, Local 2737-10
on behalf of workers at Ruger Equipment, Inc., Uhrichsville, Ohio.
The workers produced load lifting and material handling equipment.
The investigation revealed that criterion (3) has not been
met.


The investigation revealed that the subject firm did not
import load lifting and material handling equipment during the
relevant period. Moreover, the investigation revealed that United
States aggregate imports of load lifting and material handling
equipment declined during the relevant period.
Conclusion
After careful review, I determine that all workers at Ruger
Equipment, Inc., Uhrichsville, Ohio engaged in employment related
to the production of load lifting and material handling equipment,
are denied eligibility to apply for adjustment assistance under
Section 223 of the Trade Act of 1974.
