Amended Certification Regarding Eligibility to
Apply for Worker Adjustment Assistance
In accordance with Section 223 of the Trade Act of 1974 (19
USC 2273) the Department of Labor issued a Notice of
Certification Regarding Eligibility to Apply for Worker
Adjustment Assistance on July 1, 2002, applicable to workers of
Victor Forstmann, Inc, Dublin, Georgia. The notice was published
in the Federal Register on July 18, 2002 (67 FR 47400).
At the request of the petitioners, the Department reviewed
the certification for workers of the subject firm. The workers
are engaged in the production of woolen and worsted fabrics.
The company reports that worker separations occurred at the
New York, New York location of the subject firm. The New York,
New York workers provide sales, designing and marketing function
services for the subject firm’s production facility in Dublin,
Georgia.
Based on these findings, the Department is amending the
certification to include workers of Victor Forstmann, Inc., New
York, New York.
The intent of the Department’s certification is to include
all workers of Victor Forstmann, Inc. who were adversely affected
by increased imports.
The amended notice applicable to TA-W-41,391 is hereby
issued as follows:
"All workers of Victor Forstmann, Inc., Dublin Georgia
(TA-W-41,391) and Victor Forstmann, Inc., New York, New York
(TA-W-41,391A) who became totally or partially separated
from employment on or after March 22, 2001, through July 1,
2004, are eligible to apply for adjustment assistance under
Section 223 of the Trade Act of 1974.

Certification Regarding Eligibility
To Apply for Worker Adjustment Assistance
In accordance with Section 223 of the Trade Act of 1974 (19
USC 2273) as amended by the Omnibus Trade and Competitiveness Act
of 1988 (P. L. 100-418), the Department of Labor herein presents
the results of an investigation regarding certification of eligi-
bility to apply for worker adjustment assistance.
In order to make an affirmative determination and issue a
certification of eligibility to apply for adjustment assistance
each of the group eligibility requirements of Section 222 of the
Act must be met. It is determined in this case that all of the
requirements have been met.
The investigation was initiated in response to a petition
received on April 22, 2002, and filed on behalf of all workers at
Victor Forstmann, Inc., Dublin, Georgia. The workers produce
woolen and worsted fabric and are not separately identifiable by
product line.
This investigation revealed that sales, production and
employment declined at the subject plant in the relevant period.
The Department of Labor conducted a survey of the major
customers of the subject firm regarding purchases of woolen and
worsted fabric. The results of the survey show that the major
customers increased their purchases of imported woolen and
worsted fabric in the relevant period, while reducing purchases
from Victor Forstmann, Inc.
Conclusion
After careful review of the facts obtained in the investi-
gation, I conclude that increases of imports of articles like or
directly competitive with woolen and worsted fabric produced at
Victor Forstmann, Inc., Dublin, Georgia, contributed importantly
to the decline in sales or production and to the total or partial
separation of workers of that firm. In accordance with the
provisions of the Act, I make the following certification:
"All workers of Victor Forstmann, Inc., Dublin, Georgia, who
became totally or partially separated from employment on or
after March 22, 2001, through two years from the date of
this certification, are eligible to apply for adjustment
assistance under Section 223 of the Trade Act of 1974."
