Certification Regarding Eligibility
To Apply for Worker Adjustment Assistance

In accordance with Section 223 of the Trade Act of 1974 (19
USC 2273) as amended by the Omnibus Trade and Competitiveness Act
of 1988 (P. L. 100-418), the Department of Labor herein presents
the results of an investigation regarding certification of eli-
gibility to apply for worker adjustment assistance.
In order to make an affirmative determination and issue a
certification of eligibility to apply for adjustment assistance
each of the group eligibility requirements of Section 222 of the
Act must be met. It is determined in this case that all of the
requirements have been met.
The investigation was initiated in response to a petition
filed by a company official on behalf of workers producing men's
and women's denim 5-pocket bottoms and khaki casual dress pants
at Levi Strauss & Co., San Francisco Manufacturing Plant, San
Francisco, California; Blue Ridge Manufacturing Plant, Blue
Ridge, Georgia; Powell Manufacturing Plant, Powell, Tennessee;
Brownsville Manufacturing Plant, Brownsville, Texas; Kastrin
Manufacturing Plant, El Paso, Texas; San Antonio Finishing Plant,
San Antonio, Texas; San Benito Manufacturing Plant, San Benito,
Texas; and, workers of Levi Strauss & Co. providing
administrative and support services at Little Rock Customer
Service Center, Little Rock, Arkansas; Hebron Customer Service
Center, Hebron, Kentucky; Sky Harbor Customer Service Center,
Henderson, Nevada; Canton Customer Service Center, Canton,
Mississippi; CF Regional Dallas Office, Dallas, Texas; Westlake
Data Center, Westlake, Texas; San Francisco Headquarters, San
Francisco, California; and Oak Road Office, Walnut Creek,
California.
The investigation revealed that sales or production declined
at each of the Levi Strauss & Co. plants producing men's and
women's denim 5-pocket bottoms and khaki casual dress pants.
All of the locations subject of this investigation have had
reduced levels of employment or a threat of separation exists.
Company imports of denim 5-pocket bottoms and khaki casual
dress pants increased from 2000 to 2001; and increased relative
to domestic production in the period from January-April 2001 to
January-April 2002.
A petition for NAFTA-Transitional Adjustment Assistance has
been filed on behalf of workers at the subject facilities (NAFTA-
6095). A determination on that petition will be made
concurrently with this determination.
Conclusion
After careful review of the facts obtained in the investi-
gation, I conclude that increases of imports of articles like or
directly competitive with those produced by Levi Strauss & Co.'s
Blue Ridge Manufacturing Plant, Blue Ridge, Georgia; the San
Francisco Manufacturing Plant, San Francisco, California; the
Brownsville Manufacturing Plant, Brownsville, Texas; the San
Antonio Finishing Plant, San Antonio, Texas; and the San Benito
Manufacturing Plant, San Benito, Texas, contributed importantly
to the decline in sales or production and to the total or partial
separation of workers at the subject facilities. In accordance
with the provisions of the Act, I make the following
certification:
"All workers at Levi Strauss & Co.'s San Francisco
Manufacturing Plant, San Francisco, California; Blue
Ridge Manufacturing Plant, Blue Ridge, Georgia; Powell
Manufacturing Plant, Powell, Tennessee; Brownsville
Manufacturing Plant, Brownsville, Texas; Kastrin
Manufacturing Plant, El Paso, Texas; San Antonio
Finishing Plant, San Antonio, Texas; San Benito
Manufacturing Plant, San Benito, Texas; Little Rock
Customer Service Center, Little Rock, Arkansas; Hebron
Customer Service Center, Hebron, Kentucky; Sky Harbor
Customer Service Center, Henderson, Nevada; Canton
Customer Service Center, Canton, Mississippi; CF
Regional Dallas Office, Dallas, Texas; Westlake Data
Center, Westlake, Texas; San Francisco Headquarters,
San Francisco, California; and the Oak Road Office,
Walnut Creek, California who became totally or
partially separated from employment on or after April
11, 2001, through two years from the date of
certification, are eligible to apply for adjustment
assistance under Section 223 of the Trade Act of 1974."
