Amended Certification Regarding Eligibility to
Apply for Worker Adjustment Assistance

In accordance with Section 223 of the Trade Act of 1974 (19
USC 2273) the Department of Labor issued a Certification of
Eligibility to Apply for Worker Adjustment Assistance on June 21,
2002, applicable to workers of MeadWestvaco, Rumford, Maine. The
notice was published in the Federal Register on July 9, 2002 (67
FR 45544). The certification was amended on July 9, 2002 to
include leased workers of the above-mentioned firms employed at
the Rumford, Maine location of the subject firm.
At the request of the petitioners, the Department reviewed
the certification for workers of the subject firm. New
information shows that some employees of MeadWestvaco were leased
from Siemens Business Systems to produce coated groundwood paper,
freesheet paper and market pulp at the Rumford, Maine location of
the subject firm.
Based on these findings, the Department is again amending
the certification to include leased workers of Siemens Business
Systems producing coated groundwood paper and freesheet paper and
market pulp at the Rumford, Maine location of the subject firm.


The intent of the Department's certification is to include
all workers of MeadWestvaco adversely affected by imports.
The amended notice applicable to TA-W-41,327 is hereby
issued as follows:
"All workers of MeadWestvaco, Rumford, Maine, and
leased workers of Bancroft Contracting, Denali Fire
Protection, WF Porter, Mechanical Services, Cinbro
Contracting, ES Boulos, CP Technologies, Arbon
Equipment and Siemens Business Systems, Rumford, Maine,
engaged in employment related to the production of
coated groundwood and freesheet paper and market pulp
at MeadWestvaco, Rumford, Maine, who became totally or
partially separated from employment on or after March
22, 2001, through June 21, 2004, are eligible to apply
for adjustment assistance under Section 223 of the
Trade Act of 1974."

Certification Regarding Eligibility
To Apply for Worker Adjustment Assistance

In accordance with Section 223 of the Trade Act of 1974 (19
USC 2273) as amended by the Omnibus Trade and Competitiveness Act
of 1988 (P. L. 100-418), the Department of Labor herein presents
the results of an investigation regarding certification of eligi-
bility to apply for worker adjustment assistance.
In order to make an affirmative determination and issue a
certification of eligibility to apply for adjustment assistance
each of the group eligibility requirements of Section 222 of the
Act must be met. It is determined in this case that all of the
requirements have been met.
The investigation was initiated in response to a petition
received on April 15, 2002 and filed by International Union of
Paper, Allied-Industrial, Chemical and Energy Workers, Local 900;
International Brotherhood of Electrical Workers, Local 2144; and, a
company official on behalf of workers at MeadWestvaco, Rumford,
Maine. The workers produced coated groundwood and freesheet paper
and market pulp.
The investigation revealed that production and employment
declined at MeadWestvaco, Rumford, Maine plant. Coated paper was
the primary output at the plant.
The investigation further revealed that U.S. imports of paper
and paperboard for writing, printing or other graphic purposes,
clay coated except light-weight, over 10% mechanical fibers, in
rolls or sheets increased in 2001 compared to 2000.
The Department conducted a survey of major declining customers
of the subject firm regarding their purchases of print and writing
coated papers and coated label and specialty packaging papers in
January-March 2001 and January-March 2002. The survey revealed that
respondents increased their purchases of print and writing coated
papers and coated label and specialty packaging papers from foreign
firms relative to their purchases from the subject.
Conclusion
After careful review of the facts obtained in the investi-
gation, I conclude that increases of imports of articles like or
directly competitive with coated groundwood and freesheet produced
at MeadWestvaco, Rumford, Maine, contributed importantly to the
decline in sales or production and to the total or partial
separation of workers of that firm. In accordance with the
provisions of the Act, I make the following certification:


"All workers of MeadWestvaco, Rumford, Maine, who became
totally or partially separated from employment on or after
March 22, 2001 through two years from the date of
certification are eligible to apply for adjustment assistance
under Section 223 of the Trade Act of 1974."
