Negative Determination Regarding Eligibility
To Apply for Worker Adjustment Assistance
In accordance with Section 223 of the Trade Act of 1974 (19
USC 2273) as amended by the Omnibus Trade and Competitiveness Act
of 1988 (P. L. 100-418), the Department of Labor herein presents
the results of an investigation regarding certification of eligi-
bility to apply for worker adjustment assistance.
In order to make an affirmative determination and issue a
certification of eligibility to apply for adjustment assistance,
each of the group eligibility requirements of Section 222 of the
Act must be met:
(1) that a significant number or proportion of the workers in
the workers' firm, or an appropriate subdivision thereof,
have become totally or partially separated, or are
threatened to become totally or partially separated;
(2) that sales or production, or both, of the firm or subdi-
vision have decreased absolutely; and
(3) that increases of imports of articles like or directly
competitive with articles produced by the firm or appro-
priate subdivision have contributed importantly to the
separations, or threat thereof, and to the absolute
decline in sales or production.
The investigation was initiated on April 15, 2002 in response
to a petition filed by the company on behalf of workers at
Semitool, Inc., Kalispell, Montana (TA-W-41,286); Semitool
California, San Jose, California (TA-W-41,286A); Semitool Inc.,
Western Office, Beaverton, Oregon (TA-W-41,286B); Semitool Inc.,
Central Office, Dallas, Texas (TA-W-41,286C); Semitool Inc., Austin
Office, Austin, Texas (TA-W-41,286D); Semitool Inc., Southwest
Office, Tempe, Arizona (TA-W-41,286E); Semitool Inc., Southeast
Office, Cary, North Carolina (TA-W-41,286F); Semitool Inc.,
Northeast Office, Nashua, New Hampshire (TA-W-41,286G); and,
Semitool, Inc., Libby Plant, Libby, Montana (TA-W-41,286H). The
workers produced chemical and thermal processing equipment and
wafer carrier cleaning tools for the semiconductor industry at
Kalispell and Libby, Montana; and, provided sales and service at
the other locations.
The investigation revealed that criterion (3) has not been
met.
U.S. imports of spin dryers for semiconductor wafer processing
decreased in 2001 compared to 2000.
U.S. imports of centrifuges, other than cream separators,
clothes dryers or spin dryers for semiconductor wafer processing
decreased in January-March 2002 compared to the same period in
2001.
U.S. imports of spraying appliances to develop semiconductor
wafers; spray appliances to etch, develop, strip or clean flat
panel screen; certain deflash equipment decreased in in January-
March 2002 compared to the same period in 2001.
U.S. imports of machine tool for wet-etching or -stripping
semiconductor wafers; machine tool for wet-etching, -developing or
-stripping flat panel screens decreased in 2001 compared to 2000.
The Department conducted a survey of major declining domestic
customers of the subject firm regarding their purchases of chemical
and thermal processing equipment and wafer carrier cleaning tools
in 2000 and 2001. The survey revealed that none of the respondents
increased their purchases of imported chemical and thermal
processing equipment and wafer carrier cleaning tools while
decreasing their purchases of chemical and thermal processing
equipment and wafer carrier cleaning tools from the subject firm in
the relevant period.
Conclusion
After careful review, I determine that all workers of
Semitool, Inc., Kalispell, Montana; Semitool, Inc., San Jose,
California; Semitool, Inc., Beaverton, Oregon; Semitool, Inc.,
Central Office, Dallas, Texas; Semitool, Inc., Austin Office,
Austin, Texas; Semitool, Inc., Southwest Office, Tempe, Arizona;
Semitool, Inc., Southeast Office, Cary, North Carolina; Semitool,
Inc., Northeast Office, Nashua, New Hampshire; and, Semitool, Inc.,
Libby Plant, Libby, Montana are denied eligibility to apply for
adjustment assistance under Section 223 of the Trade Act of 1974.
