Notice of Termination of Certification
Pursuant to Section 223 of the Trade Act of 1974, on June 4,
2002, the Department of Labor issued a Certification of
Eligibility to Apply for Worker Adjustment Assistance applicable
to workers of the subject firm. The notice was published in the
Federal Register on June 21, 2002 (67 FR 42285).
The State agency requested that the Department review the
certification for workers of the subject firm engaged in the
production of work boots. Information shows that the E.J.
Footwear LLC certification, TA-W-40,899, was amended on July 15,
2002 to include workers at the Franklin, Tennessee and Vestal
(Endicott), New York locations of the subject firm.
Consequently, continuance of this certification would serve
no purpose and the certification is terminated.

Certification Regarding Eligibility
To Apply for Worker Adjustment Assistance
In accordance with Section 223 of the Trade Act of 1974 (19 USC
2273) as amended by the Omnibus Trade and Competitiveness Act of
1988 (P. L. 100-418), the Department of Labor herein presents the
results of an investigation regarding certification of eligibility
to apply for worker adjustment assistance.
In order to make an affirmative determination and issue a
certification of eligibility to apply for adjustment assistance each
of the group eligibility requirements of Section 222 of the Act must
be met. It is determined in this case that all of the requirements
have been met.
The investigation was initiated in response to a petition
received on March 11, 2002 and filed by a company official on behalf
of workers at E.J. Footwear LLC, Franklin, Tennessee (TA-W-41,015);
and, E.J. Footwear LLC, Endicott, New York (TA-W-40,015A). The
workers were engaged in the production of work boots.
The investigation revealed that the E.J. Footwear LLC facility
in Franklin, Tennessee received and provided raw material goods for
and to the company manufacturing facility in Blairsville, Georgia.
The E.J. Footwear LLC facility in Endicott, New York was a
distribution center that received all finished goods from the
Blairsville manufacturing plant. The company closed permanently on
March 29, 2002.
All of the workers at E.J. Footwear LLC, Blairsville, Georgia
were certified as eligible to apply for adjustment assistance on
April 3, 2002 (TA-W-40,899).
Conclusion
After careful review of the facts obtained in the investi-
gation, I conclude that increases of imports of articles like or
directly competitive with work boots produced at E.J. Footwear LLC,
Franklin, Tennessee; and, E.J. Footwear LLC, Endicott, New York
contributed importantly to the decline in sales or production and to
the total or partial separation of workers of that firm. In
accordance with the provisions of the Act, I make the following
certification:
"All workers of E.J. Footwear LLC, Franklin, Tennessee; and,
E.J. Footwear LLC, Endicott, New York who became totally or
partially separated from employment on or after February 14,
2001 through two years from the date of the certification are
eligible to apply for adjustment assistance under Section 223
of the Trade Act of 1974."
