Certification Regarding Eligibility
To Apply for Worker Adjustment Assistance
In accordance with Section 223 of the Trade Act of 1974 (19
USC 2273) as amended by the Omnibus Trade and Competitiveness Act
of 1988 (P. L. 100-418), the Department of Labor herein presents
the results of an investigation regarding certification of
eligibility to apply for worker adjustment assistance.
In order to make an affirmative determination and issue a
certification of eligibility to apply for adjustment assistance
each of the group eligibility requirements of Section 222 of the
Act must be met. It is determined in this case that all of the
requirements have been met.
The investigation was initiated in response to a petition
received on February 4, 2002 and filed on behalf of workers at Sony
Electronics, Inc., Sony Technology Center (STC), Aperture Grille
Division, Mt. Pleasant, Pennsylvania (TA-W-40,757); Sony
Electronics, Inc., Sony Technology Center, Projection Television
Picture Tube Division, Mt. Pleasant, Pennsylvania (TA-W-40,757A);
and Sony Electronics, Inc., Sony Technology Center, Pittsburgh
Television Group, Mt. Pleasant, Pennsylvania (TA-W-40,757B). The
workers produced large screen rear projection and direct view
televisions.
The investigation revealed that U.S. imports of receivers
incomplete or unfinished color reception apparatus, without cathode
ray tude, flat panel screen, or similar display, not incorporating
VCR or player increased in January 2002 compared to January 2001.
U.S. imports of non-high definition color television reception
apparatus, nonprojection, with CRT, video display diagonal over
35.56 cm, not incorporating VCR or player increased in January 2002
compared to January 2001.
U.S. imports of for non-high definition color television
reception apparatus, projection type, with cathode ray tube, not
incorporating VCR or player increased in 2001 compared to 2000 and
in January 2002 compared to January 2001.
U.S. imports of high definition color television reception
apparatus, projection type, with cathode ray tube, not
incorporating VCR or player increased in January 2002 compared to
January 2001.
The Department conducted a survey of customers of the subject
firm regarding their purchases of large screen rear projection and
direct view televisions in 1999, 2000 and January-September 2001.
The survey revealed that a respondent, that accounted for a
significant percentage of the survey group, increased its purchases
of large screen rear projection and direct view televisions from
foreign sources while decreasing its purchases from the large
screen rear projection and direct view televisions from the subject
firm in January-September 2001 compared to the same period in 2000.
Conclusion
After careful review of the facts obtained in the
investigation, I conclude that increases of imports of articles
like or directly competitive with large screen rear projection and
direct view televisions produced at Sony Electronics, Inc., Sony
Technology Center (STC), Aperture Grille Division, Mt. Pleasant,
Pennsylvania; Sony Electronics, Inc., Sony Technology Center,
Projection Television Picture Tube Division, Mt. Pleasant,
Pennsylvania; and Sony Electronics, Inc., Sony Technology Center,
Pittsburgh Television Group, Mt. Pleasant, Pennsylvania contributed
importantly to the decline in sales or production and to the total
or partial separation of workers of that firm. In accordance with
the provisions of the Act, I make the following certification:
"All workers of Sony Electronics, Inc., Sony Technology Center
(STC), Aperture Grille Division, Mt. Pleasant, Pennsylvania;
Sony Electronics, Inc., Sony Technology Center, Projection
Television Picture Tube Division, Mt. Pleasant, Pennsylvania;
and Sony Electronics, Inc., Sony Technology Center, Pittsburgh
Television Group, Mt. Pleasant, Pennsylvania who became
totally or partially separated from employment on or after
October 10, 2000 through two years from the date of
certification are eligible to apply for adjustment assistance
under Section 223 of the Trade Act of 1974."
