Amended Certification Regarding Eligibility to
Apply for Worker Adjustment Assistance
In accordance with Section 223 of the Trade Act of 1974 (19
USC 2273) the Department of Labor issued a Certification of
Eligibility to Apply for Worker Adjustment Assistance on October
23, 2002, applicable to workers of Milkan Group, New York, New
York. The notice was published in the Federal Register on
November 5, 2002 (67 FR 67420).
At the request of the State agency, the Department reviewed
the certification for workers of the subject firm. The workers
produced ladies' skirts and pants. The review shows that the
notice incorrectly identified the company name and city.
Consequently, the Department is amending the certification to
reflect the correct spelling of the company name to read Mikan
Group, Inc., and the city in New York where the plant was located
to read Long Island City.
The amended notice applicable to TA-W-40,728 is hereby
issued as follows:
"All workers at Mikan Group, Inc., Long Island City, New
York, who became totally or partially separated from
employment on or after December 5, 2000, through October 23,
2004, are eligible to apply for adjustment assistance under
Section 223 of the Trade Act of 1974."

Certification Regarding Eligibility
To Apply for Worker Adjustment Assistance
In accordance with Section 223 of the Trade Act of 1974 (19
USC 2273) as amended by the Omnibus Trade and Competitiveness Act
of 1988 (P. L. 100-418), the Department of Labor herein presents
the results of an investigation regarding certification of eligi-
bility to apply for worker adjustment assistance.
In order to make an affirmative determination and issue a
certification of eligibility to apply for adjustment assistance
each of the group eligibility requirements of Section 222 of the
Act must be met. It is determined in this case that all of the
requirements have been met.
The investigation was initiated on February 4, 2002, in
response to a petition filed by the Union of Needletrades,
Industrial and Textile Employees, Local 23-25 on behalf of workers
at Milkan Group, Inc., New York, New York. The workers produced
ladies skirts and pants and are not separately identifiable by
product line.
The investigation revealed absolute declines in sales,
production and employment at the subject firm during January
through August of 2002 when compared to the same time period in
2001.
Furthermore, the investigation revealed that data for
women's and girls' skirts revealed that U.S. imports increased
relative to U.S. shipments from 2000 to 2001. Data for women's
and girls' slacks and shorts reveals that imports increased in
the twelve months ending March 2002 compared to the twelve months
ending 2001.
Conclusion
After careful review of the facts obtained in the investi-
gation, I conclude that increases in imports of products like or
directly competitive with those produced by the subject firm
contributed importantly to the decline in sales or production and
to the total or partial separation of workers of that firm. In
accordance with the provisions of the Trade Act, I make the
following certification:
"All workers at Milkan Group, Inc., New York, New York, who
became totally or partially separated from employment on or
after December 5, 2000, through two years from the date of
certification, are eligible to apply for adjustment
assistance under Section 223 of the Trade Act of 1974."
