Certification Regarding Eligibility
To Apply for Worker Adjustment Assistance

In accordance with Section 223 of the Trade Act of 1974 (19
USC 2273) as amended by the Omnibus Trade and Competitiveness
Act of 1988 (P. L. 100-418), the Department of Labor herein
presents the results of an investigation regarding certification
of eligibility to apply for worker adjustment assistance.
In order to make an affirmative determination and issue a
certification of eligibility to apply for adjustment assistance
each of the group eligibility requirements of Section 222 of the
Act must be met. It is determined in this case that all of the
requirements have been met.
The investigation was initiated on January 14, 2002 in
response to a petition filed by a company official on behalf of
workers at Bestform Inc., located in Johnstown, Windber and
Sidman, Pennsylvania. Workers are engaged in the production of
intimate apparel (bras and panties).
This investigation covers four facilities: Broad Street
Sewing Facility, Johnstown Distribution Center, Windber Cutting
Facility, and Sidman Distribution Center. These facilities are
vertically integrated and work done at each facility is not
separable by product line.
The investigation revealed that production and employment
at the subject facility declined in 2001 compared to 2000.
The ratio of United States imports to domestic shipments of
foundation garments increased the twelve-month period ending
June 2001 (132 percent) relative to the corresponding period in
2000 (124 percent). Similarly, United States imports to domestic
shipments of underwear jumped in the twelve-month period ending
June 2001 (209 percent) relative to the corresponding period in
2000 (175 percent).
Workers at Bestform Inc., Broad Street Sewing Facility,
Johnstown, Pennsylvania were certified for trade adjustment
assistance that expired on December 21, 2001 (TA-W-36,997).
Conclusion
After careful review of the facts obtained in the
investigation, I conclude that increases of articles like or
directly competitive with imports of intimate apparel produced
at the subject facilities, contributed importantly to the
decline in sales or production and to the partial separation of
workers of that firm. In accordance with the provisions of the
Act, I make the following certification:
"All workers of Bestform Intimates, Johnstown Distribution
Center, Johnstown, Pennsylvania (TA-W-40563A); Windber
Cutting Facility, Windber, Pennsylvania (TA-W-40563B); and
Sidman Distribution Center, Sidman, Pennsylvania (TA-W-
40563C), who became totally or partially separated from
employment on or after October 17, 2000; and all workers of
Bestform Inc., Broad Street Sewing Facility, Johnstown
Pennsylvania (TA-W-40563) who became totally or partially
separated from employment on or after December 23, 2001,
through two years from the date of certification are
eligible to apply for adjustment assistance under Section
223 of the Trade Act of 1974."
