Amended Certification Regarding Eligibility to
Apply for Worker Adjustment Assistance

In accordance with Section 223 of the Trade Act of 1974 (19
USC 2273) the Department of Labor issued a Notice of
Certification Regarding Eligibility to Apply for Worker
Adjustment Assistance on May 7, 2002, applicable to workers of
Bayer Clothing Group, Inc., Target Square Facility, Clearfield,
Pennsylvania. The notice was published in the Federal Register
on May 17, 2002 (67 FR 35141).
At the request of the company, the Department reviewed the
certification for workers of the subject firm. The workers were
engaged in the production of men's sports coats, suit coats,
blazers and slacks.
New information shows that worker separations occurred at
the Macclenny Products, Lake Butler Facility, Lake Butler,
Florida and Macclenny Products, Macclenny, Florida locations of
Bayer Clothing Group, Inc. The Lake Butler, Florida location
which closed in April, 2002 and the Macclenny, Florida location
provided warehousing and distribution services for Bayer Clothing
Group, Inc. production facilities including Clearfield,
Pennsylvania.
Accordingly, the Department is amending the certification
to cover the workers of Bayer Clothing Group, Inc., Macclenny
Products, Lake Butler, Florida and Macclenny, Florida.
The intent of the Department=s certification is to include
all workers of Bayer Clothing Group, Inc. who were adversely
affected by increased imports.


The amended notice applicable to TA-W-40,516 is hereby
issued as follows:
"All workers of Bayer Clothing Group, Inc., Target Square
Facility, Clearfield, Pennsylvania (TA-W-40,516) who became
totally or partially separated from employment on or after
January 22, 2002, through May 7, 2004, and Bayer Clothing
Group, Inc., Macclenny Products, Lake Butler Facility, Lake
Butler, Florida (TA-W-40,516C) and Bayer Clothing Group,
Inc., Macclenny Products, Macclenny, Florida (TA-W-40,516D)
who became totally or partially separated from employment on
or after December 4, 2000, through May 7, 2004, are eligible
to apply for adjustment assistance under Section 223 of the
Trade Act of 1974."

Certification Regarding Eligibility
To Apply for Worker Adjustment Assistance

In accordance with Section 223 of the Trade Act of 1974 (19
USC 2273) as amended by the Omnibus Trade and Competitiveness Act
of 1988 (P. L. 100-148), the Department of Labor herein presents
the results of an investigation regarding certification of eli-
gibility to apply for worker adjustment assistance.
In order to make an affirmative determination and issue a
certification of eligibility to apply for adjustment assistance
each of the group eligibility requirements of Section 222 of the
Act must be met. It is determined in this case that all of the
requirements have been met.
The investigation was initiated in response to a petition
received on December 31, 2001, filed by the UNITE union on behalf
of workers at Bayer Clothing Group, Inc., Clearfield and
Curwensville, Pennsylvania. The workers produced men's sports
coats, suit coats, blazers and slacks.
Investigation findings revealed that the subject facilities
have experienced decreases in sales, production and levels of
employment
The investigation also showed that the subject firm is
increasing its reliance on imports of articles like or directly
competitive with those that it produces.
United States imports of articles like and competitive with
those produced by the subject firm showed that they increased
during the twelve months ending in September 2001. In 2000, U.S.
imports relative to domestic shipments of men's and boys' coats
and jackets reached a historic high: nearly 500 percent.
Workers at these plants were previously certified eligible
to apply for TAA under petition number TA-W-36,990, which expired
January 21, 2002.
Conclusion
After careful review of the facts obtained in the
investigation, I conclude that increases of imports of articles
like or directly competitive with those produced by the Bayer
Clothing Group, Inc., Clearfield and Curwensville, Pennsylvania,
contributed importantly to the decline in sales or production and
to the total or partial separation of workers of the subject
firm. In accordance with the provisions of the Act, I make the
following certification:


"All workers at the Bayer Clothing Group, Inc., Target
Square facility, Clearfield, Pennsylvania; Fletcherville,
facility, Clearfield, Pennsylvania; and Kent facility,
Curwensville, Pennsylvania, who became totally or partially
separated from employment on or after January 22, 2002,
through two years from the date of certification are
eligible to apply for adjustment assistance under Section
223 of the Trade Act of 1974."
