Certification Regarding Eligibility
To Apply for Worker Adjustment Assistance
In accordance with Section 223 of the Trade Act of 1974 (19
USC 2273) as amended by the Omnibus Trade and Competitiveness Act
of 1988 (P. L. 100-418), the Department of Labor herein presents
the results of an investigation regarding certification of
eligibility to apply for worker adjustment assistance.
In order to make an affirmative determination and issue a
certification of eligibility to apply for adjustment assistance
each of the group eligibility requirements of Section 222 of the
Act must be met. It is determined in this case that all of the
requirements have been met.
The investigation was initiated in response to a petition
received on December 21, 2001 and filed by the United Steelworkers
of America, on behalf of workers at Kaiser Aluminum & Chemical
Corporation, Tacoma Rod Mill, Tacoma, Washington (TA-W-40,493);
Kaiser Aluminum & Chemical Corporation, Mead, Washington (TA-W-
40,493A); and, Kaiser Aluminum & Chemical Corporation, Trentwood,
Washington (TA-W-40,493B). The workers at the Mead smelting
facility produced primary aluminum, at the Tacoma rod mill produced
aluminum continuous-cast rod, and at the Trentwood flat-rolling
mill produced aluminum plate and sheet.
The investigation revealed that U.S. imports of aluminum
(other than alloy), unwrought not elsewhere specified or
otherwise indicated increased in 2001 compared to 2000.
U.S. imports of rod and bars increased in 2000 compared to
1999.
U.S. imports of plate, sheet, strip, etc., n.e.c. increased
in 2000 compared to 1999.
Company imports of primary aluminum increased in 2001
compared to 2000.
The Department conducted a survey of major declining customers
of Kaiser Aluminum Tacoma regarding their purchases of electric
conductor and deox rod in 1999, 2000 and January-September 2001.
The survey revealed that a respondent which accounted for a
significant percentage of the subject plant's decline in sales in
January-September 2001(est.) compared to the same period in 2000
increased its purchases of electric conductor rod from foreign
firms while decreasing its purchases of electric conductor rod from
the subject firm in January-September 2001 compared to the same
period in 2000.
The Department conducted a survey of major declining customers
of Kaiser Aluminum Trentwood regarding their purchases of aluminum
plate and sheet in 1999, 2000 and January-September 2001. The
survey revealed that respondents that accounted for a significant
percentage of the subject plant's decline in sales in January-
September 2001(est.) compared to the same period in 2000 increased
their purchases of imported aluminum plate and sheet while
decreasing their purchases of aluminum plate and sheet from the
subject firm in January-September 2001 compared to the same period
in 2000.
Conclusion
After careful review of the facts obtained in the investi-
gation, I conclude that increases of imports of articles like or
directly competitive with primary aluminum, aluminum continuous-
cast rod and aluminum plate and sheet products produced at Kaiser
Aluminum & Chemical Corporation, Tacoma Rod Mill, Tacoma,
Washington; Kaiser Aluminum & Chemical Corporation, Mead,
Washington; and, Kaiser Aluminum & Chemical Corporation, Trentwood,
Washington contributed importantly to the decline in sales or
production and to the total or partial separation of workers of
that firm. In accordance with the provisions of the Act, I make the
following certification:
"All workers of Kaiser Aluminum & Chemical Corporation, Tacoma
Rod Mill, Tacoma, Washington; Kaiser Aluminum & Chemical
Corporation, Mead, Washington; and, Kaiser Aluminum & Chemical
Corporation, Trentwood, Washington who became totally or
partially separated from employment on or after November 9,
2000 through two years from the date of certification are
eligible to apply for adjustment assistance under Section 223
of the Trade Act of 1974."
