Notice of Determinations Regarding Eligibility
To Apply for Worker Adjustment Assistance
In accordance with Section 223 of the Trade Act of 1974 (19
USC 2273) as amended by the Omnibus Trade and Competitiveness Act
of 1988 (P. L. 100-418), the Department of Labor herein presents
the results of an investigation regarding certification of
eligibility to apply for worker adjustment assistance.
In order to make an affirmative determination and issue a
certification of eligibility to apply for adjustment assistance
each of the group eligibility requirements of Section 222 of the
Act must be met.
The investigation was initiated in response to a petition
received on December 3, 2001 and filed by the United Automobile,
Aerospace & Agricultural Implement Workers of America, Local 871 on
behalf of workers and former workers at Dometic Corporation, Air
Conditioning Line, LaGrange, Indiana (TA-W-40,436) and Dometic
Corporation, Awning Line, LaGrange, Indiana (TA-W-40,436A). The
workers produced air conditioners and awnings.
It has been determined with respect to production of air
conditioners that all of the criteria have been met.
The investigation revealed that employment of workers and
production at Dometic Corporation, Air Conditioning Line, LaGrange,
Indiana has declined.
The investigation further revealed that the company increased
its imports of air conditioners during the relevant period.
It has been determined with respect to production of awnings
that criterion (3) has not been met.
The Department conducted a survey of major customers of the
subject firm regarding their purchases of awnings. The survey
revealed that the customers had no imports from abroad of awnings.
Conclusion
After careful review of the facts obtained in the investi-
gation, I conclude that increases of imports of articles like or
directly competitive with air conditioners contributed importantly
to the decline in sales or production and to the total or partial
separation of workers of that firm. In accordance with the
provisions of the Act, I make the following certification:
"All workers of Dometic Corporation, Air Conditioning Line,
LaGrange, Indiana engaged in employment related to the
production of air conditioners who became totally or partially
separated from employment on or after November 12, 2000 are
eligible to apply for adjustment assistance under Section 223
of the Trade Act of 1974."
"I further determine that all workers at Dometic Corporation,
Awning Line, LaGrange, Indiana are denied eligibility to apply
for adjustment assistance under Section 223 of the Trade Act
of 1974."
