Certification Regarding Eligibility
To Apply for Worker Adjustment Assistance
In accordance with Section 223 of the Trade Act of 1974 (19
USC 2273) as amended by the Omnibus Trade and Competitiveness Act
of 1988 (P. L. 100-418), the Department of Labor herein presents
the results of an investigation regarding certification of
eligibility to apply for worker adjustment assistance.
In order to make an affirmative determination and issue a
certification of eligibility to apply for adjustment assistance
each of the group eligibility requirements of Section 222 of the
Act must be met. It is determined in this case that all of the
requirements have been met.
The investigation was initiated in response to a petition
received on December 10, 2001 and filed by a company official at
the Lady Ester Lingerie Corporation, Berwick, Pennsylvania and
expanded to the divisions at the Kaydette Plant, Berwick,
Pennsylvania (TA-W-40,396A), Briar Creek Plant, Berwick,
Pennsylvania (TA-W-40,396B), and New York, New York (TA-W-
40,396C). The workers at the subject firm are engaged in the
production of lingerie, sleepwear, daywear, children's wear,
sportswear, swimwear, and eveningwear. The petitioning firm does
sewing and shipping of the finished goods and some administrative
work. Kaydette Plant is a manufacture facility engaged in sewing
and finishing. The Briar Creek location is also a manufacturing
facility engaged in the cutting of the material.
Company imports of women and children's sleepwear increased
from 1999 through November 2001. Aggregate US import data for
1999, 2000, and 2001 indicate a significant increase of imports
of sleepwear and women and children's apparel.
Conclusion
After careful review of the facts obtained in the investi-
gation, I conclude that increases of imports of articles like or
directly competitive with lingerie, sleepwear, daywear,
children's wear, sportswear, swimwear, and eveningwear produced
at Lady Ester Lingerie Corporation, Berwick, Pennsylvania and
expanded to its divisions at the Kaydette Plant, Berwick,
Pennsylvania (TA-W-40,396A), Briar Creek Plant, Berwick,
Pennsylvania (TA-W-40,396B), and New York, New York(TA-W-
40,396C), contributed importantly to the decline in sales or
production and to the total or partial separation of workers of
that firm. In accordance with the provisions of the Act, I make
the following certification:
"All workers Lady Ester Lingerie Corporation, Berwick,
Pennsylvania (TA-40,396) and Kaydette Plant, Berwick,
Pennsylvania (TA-W-40,396A), Briar Creek Plant,
Berwick, Pennsylvania (TA-W-40,396B), and New York,
New York (TA-W-40,396C), engaged in employment related
to the production of lingerie, sleepwear, daywear,
children's wear, sportswear, swimwear, and eveningwear
who became totally or partially separated from
employment on or after October 24, 2000 are eligible
to apply for adjustment assistance under Section 223
of the Trade Act of 1974."
