Amended Certification Regarding Eligibility to
Apply for Worker Adjustment Assistance

In accordance with Section 223 of the Trade Act of 1974 (19
USC 2273) the Department of Labor issued a Certification of
Eligibility to Apply for Worker Adjustment Assistance on January
22, 2002, applicable to workers of Exolon-Esk Company, Tonawanda,
New York. The notice was published in the Federal Register on
February 5, 2002 (67 FR 5294).
At the request of the State agency, the Department reviewed
the certification for workers of the subject firm. New
information shows that worker separations occurred involving
employees of the Tonawanda, New York facility of Exolon-Esk
Company located in Illinois. These employees were engaged in
employment related to the production of man-made abrasives,
silicon carbide and aluminum oxide at the Tonawanda, New York
location of the subject firm.
Based on these findings, the Department is amending this
certification to include employees of the Tonawanda, New York
facility of Exolon-Esk Company located in Illinois.
The intent of the Department=s certification is to include
all workers of Exolon-Esk Company who were adversely affected by
increased imports.
The amended notice applicable to TA-W-40,292 is hereby
issued as follows:
"All workers of Exolon-Esk Company, Tonawanda, New
York, including employees of Exolon-Esk Company,
Tonawanda, New York, located in Illinois, who became
totally or partially separated from employment on or
after April 13, 2001, through January 22, 2004, are
eligible to apply for adjustment assistance under
Section 223 of the Trade Act of 1974."

Certification Regarding Eligibility
To Apply for Worker Adjustment Assistance

In accordance with Section 223 of the Trade Act of 1974 (19 USC
2273) as amended by the Omnibus Trade and Competitiveness Act of 1988
(P. L. 100-418), the Department of Labor herein presents the results
of an investigation regarding certification of eligibility to apply
for worker adjustment assistance.
In order to make an affirmative determination and issue a
certification of eligibility to apply for adjustment assistance each
of the group eligibility requirements of Section 222 of the Act must
be met. It is determined in this case that all of the requirements
have been met.
The investigation was initiated on October 29, 2001, in response to a petition filed by workers at
Exolon-ESK Company, Tonawanda, New York. Workers produce man-made abrasives, silicon carbide
and aluminum oxide. The workers are not separately identifiable by product.
The investigation revealed that employment, sales and production declined from 2000 to 2001.
The subject firm does not import and has no plans to begin importing.
The Department of Labor surveyed major customers of the subject firm regarding their purchases
of man-made abrasives in 1999, 2000 and January to September, 2000-2001 time periods. A major
customer significantly increased its reliance on imports of man-made abrasives during the relevant period
while decreasing purchases from the subject firm.
This worker group was previously certified eligible to apply for trade adjustment assistance on
April 12, 1999 (TA-W-35,600), which expired on April 12, 2001.
Conclusion
After careful review of the facts obtained in the investigation, I conclude that increases of imports
of articles like or directly competitive with those produced by Exolon-ESK Company, Tonawanda, New
York contributed importantly to the decline in sales or production and to the total or partial separation of
workers of that firm. In accordance with the provisions of the Trade Act, I make the following
certification:
"All workers at Exolon-ESK Company, Tonawanda, New York, who became totally or partially
separated from employment on or after April 13, 2001, through two years from the date of
certification, are eligible to apply for adjustment assistance under
Section 223 of the Trade Act of 1974."
