Certification Regarding Eligibility
To Apply for Worker Adjustment Assistance
In accordance with Section 223 of the Trade Act of 1974 (19 USC 2273) as amended by the Omnibus Trade and Competitiveness Act of 1988 (P. L. 100-418), the Department of Labor herein presents the results of an investigation regarding certification of eligi-bility to apply for worker adjustment assistance.
In order to make an affirmative determination and issue a certification of eligibility to apply for adjustment assistance, each of the group eligibility requirements of Section 222 of the Act must be met. It is determined in this case that all of the requirements have been met.
The investigation was initiated on October 9, 2001, in response to a petition filed on behalf of workers at Axiohm Transaction Solutions, Inc., American Magnetics Division, Cypress, California. The workers were engaged in the production of card readers.
Investigative findings revealed that sales, production and employment at the subject firm declined from 1999 November, 2001.
Investigative findings also revealed that the company imported card readers from China and Mexico. The subject firm closed on November 8, 2001.
A petition for NAFTA Transitional Adjustment Assistance (5374) has been filed on behalf of workers at the subject firm.
Conclusion
After careful review of the facts obtained in the investi-gation, I conclude that increases of imports of articles like
or directly competitive with card readers produced at the subject firm, contributed importantly to the decline in sales or production and to the total or partial separation of workers of that firm. In accordance with the provisions of the Act, I make the following certification:
"All workers at Axiohm Transaction Solutions, Inc., American Magnetics Division, Cypress, California, engaged in employment related to production of card readers, who became totally or partially separated from employment on or after September 20, 2000 through two years from the date of certification are eligible to apply for adjustment assistance under Section 223 of the Trade Act of 1974."

Negative Determination Regarding Eligibility
To Apply for Worker Adjustment Assistance
In accordance with Section 223 of the Trade Act of 1974 (19 USC 2273) as amended by the Omnibus Trade and Competitiveness Act of 1988 (P. L. 100-418), the Department of Labor herein presents the results of an investigation regarding certification of eligi-bility to apply for worker adjustment assistance.
In order to make an affirmative determination and issue a certification of eligibility to apply for adjustment assistance, each of the group eligibility requirements of Section 222 of the Act must be met:
(1) that a significant number or proportion of the workers in the workers' firm, or an appropriate subdivision thereof, have become totally or partially separated, or are threatened to become totally or partially separated;
(2) that sales or production, or both, of the firm or subdivision have decreased absolutely; and
(3) that increases of imports of articles like or directly competitive with articles produced by the firm or appropriate subdivision have contributed importantly to the separations, or threat thereof, and to the absolute decline in sales or production.
The investigation was initiated on October 9, 2001, in response to a petition filed by the company on behalf of workers at Axiohm Transaction Solutions, Inc., IPB Division, Ithaca, New York. The workers were engaged in the production of printer pieces for cash registers.
The investigation revealed that criterion (3) has not been met.
Investigative findings reveal that sales, or production and employment at the subject firm decreased from 1999 to 2000 and in 2001.
The investigation further revealed that there was not an increase of imports from Mexico or Canada of articles like or directly competitive with articles produced by the subject firm.
A certification of eligibility to apply for NAFTA Transitional Adjustment Assistance (NAFTA-4579) was issued on March 12, 2001, for workers of the subject firm.
Conclusion
After careful review, I determine that all workers at
Axiohm Transaction Solutions, Inc., IPB Division, Ithaca, New York, are denied eligibility to apply for adjustment assistance under Section 223 of the Trade Act of 1974.
