Negative Determination Regarding Eligibility
To Apply for Worker Adjustment Assistance

In accordance with Section 223 of the Trade Act of 1974
(19 USC 2273) as amended by the Omnibus Trade and Competitiveness
Act of 1988 (P. L. 100-418), the Department of Labor herein
presents the results of an investigation regarding certification
of eligibility to apply for worker adjustment assistance.
In order to make an affirmative determination and issue a
certification of eligibility to apply for adjustment assistance,
each of the group eligibility requirements of Section 222 of the
Act must be met:
(1) that a significant number or proportion of the workers
in the workers' firm, or an appropriate subdivision
thereof, have become totally or partially separated, or
are threatened to become totally or partially
separated;

(2) that sales or production, or both, of the firm or
subdivision have decreased absolutely; and

(3) that increases of imports of articles like or directly
competitive with articles produced by the firm or
appropriate subdivision have contributed importantly to
the separations, or threat thereof, and to the absolute
decline in sales or production.

The investigation was initiated on September 28, 2001 in
response to a petition filed by the company on behalf of workers
at American and Efird at the above-referenced locations which
have experienced worker separations in the relevant time period.
Workers are engaged in activity related to the production of
industrial and domestic sewing thread. The workers are not
separately identifiable by product line.
The investigation revealed that criterion (3) has not been
met.
The petitioner alleged that worker separations were
attributable to the general shift of apparel production offshore.
The current investigation is limited to imports of thread like
that produced by the subject firm, however.
The investigation revealed that the subject company does not
import industrial and domestic sewing thread.
The Department of Labor conducted a survey of the subject
company's major customers regarding their purchases of industrial
and domestic sewing thread during the periods 2000, 2001,
January-August 2001, and January-August 2002. The survey revealed
no increased customer import purchases during the periods of
sales and production decline at the subject company.
Conclusion
After careful review, I determine that all workers of
American and Efird, Headquarters, Mt. Holly, North Carolina;
American Plant, Mt. Holly, North Carolina; Adrian Madora Plant,
Mt. Holly, North Carolina; Brentwood Depot, Brentwood, Missouri;
Filament Plant, Mt. Holly, North Carolina; Miami Depot, Miami,
Florida; Mt. Holly 15 Dyeing and Finishing, Mt. Holly, North
Carolina; Rush Plant, Mt. Holly, North Carolina; Gastonia Plant
01, Gastonia, North Carolina; Gastonia Plant 20, Gastonia, North
Carolina; Gastonia Plant 56, Gastonia, North Carolina; Gastonia
51 Dyeing and Finishing Plant, Gastonia, North Carolina; Los
Angeles Depot, Commerce, California; Maiden Plant 11, Maiden,
North Carolina; Nashville Depot, Nashville, Tennessee; Nelson
Plant 02, Lenoir, North Carolina; Nelson Plant 12, Lenoir, North
Carolina; New York Depot, Long Island, New York; Tupelo Depot,
Tupelo, Mississippi; and Winder Depot, Winder, Georgia are denied
eligibility to apply for adjustment assistance under Section 223
of the Trade Act of 1974.
