Notice of Determinations Regarding Eligibility
To Apply for Worker Adjustment Assistance

In accordance with Section 223 of the Trade Act of 1974 (19
USC 2273) as amended by the Omnibus Trade and Competitiveness Act
of 1988 (P. L. 100-418), the Department of Labor herein presents
the results of an investigation regarding certification of
eligibility to apply for worker adjustment assistance.
In order to make an affirmative determination and issue a
certification of eligibility to apply for adjustment assistance
each of the group eligibility requirements of Section 222 of the
Act must be met.
(1) that a significant number or proportion of the workers in
the workers' firm, or an appropriate subdivision thereof,
have become totally or partially separated, or are
threatened to become totally or partially separated;

(2) that sales or production, or both, of the firm or subdi-
vision have decreased absolutely; and

(3) that increases of imports of articles like or directly
competitive with articles produced by the firm or appro-
priate subdivision have contributed importantly to the
separations, or threat thereof, and to the absolute
decline in sales or production.

The investigation was initiated in response to a petition
received on September 24, 2001 and filed by United Electrical,
Radio and Machine Workers (UE), Local 1111, on behalf of workers
and former workers at Rockwell Automation, Components and Packaged
Application Group, Department 214, Milwaukee, Wisconsin (TA-W-
40,076); Rockwell Automation, Components and Packaged Application
Group, Department 238, Milwaukee, Wisconsin (TA-W-40,076A);
Rockwell Automation, Components and Packaged Application Group,
Department 240, Milwaukee, Wisconsin (TA-W-40,076B); Rockwell
Automation, Components and Packaged Application Group, Department
245, Milwaukee, Wisconsin (TA-W-40,076C); Rockwell Automation,
Components and Packaged Application Group, Department 250/270,
Milwaukee, Wisconsin (TA-W-40,076D); Rockwell Automation,
Components and Packaged Application Group, Department 255,
Milwaukee, Wisconsin (TA-W-40,076E); and, Rockwell Automation,
Components and Packaged Application Group, Department 260,
Milwaukee, Wisconsin (TA-W-40,076F). The workers in Department 214
produced NEMA relays and timers; Department 238, IEC overlay
relays; Department, 240, NEMA push buttons, pilot lights, and
selector switches and NEMA and IEC terminal blocks; Department 245,
condition sensing devices; Department 250/270, NEMA contactors and
starters and NEMA overload relays; Department 255, NEMA disconnects
and heater elements; and, Department 260, IEC contactors and
relays.
With respect to workers at Rockwell Automation, Components and
Packaged Application Group, Department 214, Milwaukee, Wisconsin;
Rockwell Automation, Components and Packaged Application Group,
Department 238, Milwaukee, Wisconsin; Rockwell Automation,
Components and Packaged Application Group, Department 240,
Milwaukee, Wisconsin; Rockwell Automation, Components and Packaged
Application Group, Department 245, Milwaukee, Wisconsin; Rockwell
Automation, Components and Packaged Application Group, Department
250/270, Milwaukee, Wisconsin; Rockwell Automation, Components and
Packaged Application Group, Department 255, Milwaukee, Wisconsin;
Rockwell Automation, Components and Packaged Application Group,
Department 260, Milwaukee, Wisconsin producing NEMA relays and
timers; IEC overload relays; NEMA push buttons, pilot lights, and
selector switches and NEMA and IEC terminal blocks; condition
sensing devices; NEMA contactors and starters and NEMA overload
relays; heater elements; and, IEC relays respectively that
criterion (3) has not been met.
Employment of workers producing IEC terminals remained the
same in FY 2001 compared to FY 2000.
U.S. imports of motor starters, for voltage not exceeding
1,000 volts decreased in 2000 compared to 1999.
U.S. imports of motor overload relays; relays for switching,
protecting or making connections to or in electrical circuits, for
voltage exceeding 60 but not exceeding 1,000 volts; switches not
elsewhere specified or otherwise indicated (nesoi), for switching
or making connections to or in electrical circuits, for a voltage
not exceeding 1,000 volts; electrical terminals, electrical
splicers and electrical couplers; electrical apparatus nesoi, for
switching or making connections to or in electrical circuits, for a
voltage not exceeding 1,000 volts, nesoi; and , assemblies, other
than printed circuit of ceramic or metallic material, reactive to
changes in temperature decreased in January-October 2001 compared
to the same period in 2000.
Company imports of heater elements decreased both absolutely
and as a percentage of sales of heater elements in FY 2001 compared
to FY 2000.
The Department conducted a survey of customers of the subject
firm regarding their purchases of NEMA relays and timers; NEMA push
buttons, pilot lights, and selector switches; NEMA terminal blocks;
condition sensing devices; NEMA contactors and starters and NEMA
overload relays; heater elements; and, IEC relays and overload
relays in 1999, 2000 and January-September 2001. The survey
revealed that none of the respondents imported in the relevant
period.
Production of NEMA pushbuttons was transferred from the
subject plant to another domestic company facility in late FY 2001.
It has been determined with respect to workers at Rockwell
Automation, Components and Packaged Application Group, Department
255, Milwaukee, Wisconsin; and, Rockwell Automation, Components and
Packaged Application Group, Department 260, Milwaukee, Wisconsin
producing NEMA disconnects and IEC contactors respectively that all
of the criteria have been met.
U.S. imports of motor starters, for a voltage not exceeding
1,000 volts; and, electrical apparatus nesoi, for switching or
making connections to or in electrical circuits, for a voltage not
exceeding 1,000 volts, nesoi increased in 2000 compared to 1999.
Company imports of disconnects and IEC contactors increased in
FY 2001 compared to FY 2000.
Conclusion
After careful review of the facts obtained in the investi-
gation, I conclude that increases of imports of articles like or
directly competitive with NEMA disconnects and IEC contactors
produced at Rockwell Automation, Components and Packaged
Application Group, Department 255, Milwaukee, Wisconsin; Rockwell
Automation, Components and Packaged Application Group, Department
260, Milwaukee, Wisconsin contributed importantly to the decline in
sales or production and to the total or partial separation of
workers of that firm. In accordance with the provisions of the Act,
I make the following certification:
"All workers of Rockwell Automation, Components and Packaged
Application Group, Department 255, Milwaukee, Wisconsin;
Rockwell Automation, Components and Packaged Application
Group, Department 260, Milwaukee, Wisconsin engaged in
employment related to the production of NEMA disconnects and
IEC contactors respectively who became totally or partially
separated from employment on or after September 6, 2000 are
eligible to apply for adjustment assistance under Section 223
of the Trade Act of 1974."
"I further determine that all workers at Rockwell Automation,
Components and Packaged Application Group, Department 214,
Milwaukee, Wisconsin; Rockwell Automation, Components and
Packaged Application Group, Department 238, Milwaukee,
Wisconsin; Rockwell Automation, Components and Packaged
Application Group, Department 240, Milwaukee, Wisconsin;
Rockwell Automation, Components and Packaged Application
Group, Department 245, Milwaukee, Wisconsin; Rockwell
Automation, Components and Packaged Application Group,
Department 250/270, Milwaukee, Wisconsin; Rockwell Automation,
Components and Packaged Application Group, Department 255,
Milwaukee, Wisconsin; Rockwell Automation, Components and
Packaged Application Group, Department 260, Milwaukee,
Wisconsin engaged in the production of NEMA relays and timers;
IEC overload relays; NEMA push buttons, pilot lights, and
selector switches and NEMA and IEC terminal blocks; condition
sensing devices; NEMA contactors and starters and NEMA
overload relays; heater elements; and, IEC relays respectively
are denied eligibility to apply for adjustment assistance
under Section 223 of the Trade Act of 1974."
