Notice of Determinations Regarding Eligibility
To Apply for Worker Adjustment Assistance
In accordance with Section 223 of the Trade Act of 1974 (19 USC 2273) as amended by the Omnibus Trade and Competitiveness Act of 1988 (P. L. 100-418), the Department of Labor herein presents the results of an investigation regarding certification of eligi-bility to apply for worker adjustment assistance.
In order to make an affirmative determination and issue a certification of eligibility to apply for adjustment assistance each of the group eligibility requirements of Section 222 of the Act must be met.
The investigation was initiated in response to a petition received on August 13, 2001 and filed on behalf of workers and former workers at Dyersburg Fabrics, Main Plant, Dyersburg, Tennessee (TA-W-39,835); Dyersburg Fabrics, Knitting Plant, Dyersburg, Tennessee (TA-W-39,835A); and, Trenton Mills, Trenton, Tennessee (TA-W-39,835B). The subject firm is a subsidiary of Dyersburg Corporation. The workers at Dyersburg Fabrics produced primarily circular knit fleece and cotton jersey fabrics. The workers at Trenton Mills produced meat bags and medical and industrial fabrics.
It has been determined with respect to workers at Trenton Mills producing meat bags and medical and industrial fabrics that criterion (3) has not been met.
The Department conducted a survey of major declining customers of Trenton Mills regarding their purchases of meat bags in 1999, 2000 and January-June 2001. The survey revealed that none of the respondents imported in the relevant period.
The Department conducted a survey of major declining customers of Trenton Mills regarding their purchases of medical and industrial fabrics in 1999, 2000 and January-June 2001. The survey revealed that a respondent accounting for a minor percentage of subject firm sales in January-June 2000(est.) and January-June 2001(est.) increased its purchases of medical and industrial fabrics from other domestic sources that were wholly manufactured in Mexico and/or Canada while decreasing their purchases of medical and industrial fabrics in 2000 compared to 1999.
It has been determined with respect to workers at Dyersburg Fabrics that all of the criteria have been met.
The Department conducted a survey of major declining customers of Dyersburg Fabrics regarding their purchases of fleece/jersey in 1999, 2000 and January-June 2001. The survey revealed that respondents which accounted for a significant percentage of the subject firm=s decline in sales in January-June 2001(est.) compared to the same period in 2000(est.) increased their purchases of imported fleece/jersey while decreasing their purchases of fleece/jersey from the subject firm in 2000 compared to 1999 and in January-June 2001 compared to the same period in 2000.
Conclusion
After careful review of the facts obtained in the investi-gation, I conclude that increases of imports of articles like or directly competitive with circular knit fleece and cotton jersey produced at Dyersburg Fabrics, Dyersburg, Tennessee contributed importantly to the decline in sales or production and to the total or partial separation of workers of that firm. In accordance with the provisions of the Act, I make the following certification:
"All workers of Dyersburg Fabrics, Dyersburg, Tennessee who became totally or partially separated from employment on or after July 19, 2000, through two years from the date of this issuance are eligible to apply for adjustment assistance under Section 223 of the Trade Act of 1974;" and
"I further determine that all workers at Trenton Mills, Trenton, Tennessee are denied eligibility to apply for adjustment assistance under Section 223 of the Trade Act of 1974."
