Notice of Determinations Regarding Eligibility
To Apply for Worker Adjustment Assistance

In accordance with Section 223 of the Trade Act of 1974 (19 USC 2273) as amended by the Omnibus Trade and Competitiveness Act of 1988 (P. L. 100-418), the Department of Labor herein presents the results of an investigation regarding certification of eligi-bility to apply for worker adjustment assistance.
In order to make an affirmative determination and issue a certification of eligibility to apply for adjustment assistance each of the group eligibility requirements of Section 222 of the Act must be met:
(1) that a significant number or proportion of the workers in the workers' firm, or an appropriate subdivision thereof, have become totally or partially separated, or are threatened to become totally or partially separated;

(2) that sales or production, or both, of the firm or subdivision have decreased absolutely; and

(3) that increases of imports of articles like or directly competitive with articles produced by the firm or appropriate subdivision have contributed importantly to the separations, or threat thereof, and to the absolute decline in sales or production.

The investigation was initiated in response to a petition received on August 13, 2001 and filed on behalf of workers and former workers at Greenwood Mills, Inc., Executive Office, Greenwood, South Carolina (TA-W-39,813); Greenwood Mills, Inc., Chalmers Plant, Greenwood, South Carolina (TA-W-39,813A); Greenwood Mills, Inc., Lindale Manufacturing, Lindale, Georgia (TA-W-39,813B) and Greenwood Mills, Inc., Aquatech, Inc., Cookeville, Tennessee (TA-W-39,813C), are the subjects of this investigation. Greenwood Mills, Inc., Executive Office, Greenwood, South Carolina serves as the parent company for the three other petitioning plants. Greenwood Mills, Inc., Chalmers Plant, Greenwood, South Carolina primarily produce greige fabric; Greenwood Mills, Inc., Lindale Manufacturing, Lindale, Georgia produce denim fabric and the workers at Greenwood Mills, Inc., Aquatech, Inc., Cookeville, Tennessee are engaged in the production (wet-processing) of denim pants, shirts and jackets. None of the subject locations imported products similar to what was produced at the subject plant.
Greenwood Mills, Inc., Executive Office, Greenwood, South (TA-W-39,813) and Greenwood Mills, Inc., Aquatech, Inc., Cookeville, Tennessee (TA-W-39,813C)

It has been determined with respect to workers at Greenwood Mills, Inc., Aquatech, Inc., Cookeville, Tennessee (TA-W-39,813C) that all of the criteria have been met.
The investigation revealed that sales, production and employment at Greenwood Mills, Inc., Aquatech, Inc., Cookeville, Tennessee declined during the relevant period. The investigation further revealed that aggregate U.S. imports of selected apparel like and directly competitive with products produced at the subject plant increased significantly during the relevant period.
The workers of Greenwood Mills, Inc., Aquatech, Inc., Cookeville, Tennessee (TA-W-39,813C) are under an existing (TAA) certification (TA-W-36,718) which expires on November 10, 2001.
Sales and employment at Greenwood Mills, Inc., Executive Office, Greenwood, South Carolina (TA-W-39,813) declined during the relevant period. The workers were in direct support of Aquatech, Inc., Cookeville, Tennessee.
Greenwood Mills Inc., Chalmers Plant, Greenwood, South Carolina (TA-W-39,813A) and Greenwood Mills, Inc., Lindale Manufacturing, Lindale, Georgia (TA-W-39,813B)
It has been determined with respect to workers at Greenwood Mills, Inc., Chalmers Plant, Greenwood, South Carolina (TA-W-39,813A) and Greenwood Mills, Inc., Lindale Manufacturing, Lindale, Georgia (TA-W-39,813B) that criterion (3) has not been met.

The Department of Labor surveyed the major customers of the subject firm regarding their purchases of greige woven fabric and denim fabric, respectively, during the relevant period. The survey revealed that none of the respondents increased their imports of greige woven fabric or denim fabric, while decreasing their purchases from the subject plant during the relevant period.
The investigation further revealed that U.S. imports of denim fabric declined during the relevant period.
Aggregate U.S. imports of fabric have remained relatively stable during the relevant period.
Conclusion
After careful review of the facts obtained in the invest-nation, I conclude that increases of imports of articles like or directly competitive with denim garments produced at Greenwood Mills, Inc., Aquatech, Inc., Cookeville, Tennessee (TA-W-39,813C) contributed importantly to the decline in sales or production and to the total or partial separation of workers of that firm. In accordance with the provisions of the Act, I make the following certification:

"All workers of Greenwood Mills, Inc., Aquatech, Inc., Cookeville, Tennessee (TA-W-39,813C) engaged in activities related to the production (wet-processing) of denim garments who become totally or partially separated from employment on or after November 11, 2001 through two years from November 11, 2001 are eligible to apply for adjustment assistance under Section 223 of the Trade Act of 1974;" and
"All workers of Greenwood Mills, Inc., Executive Office, Greenwood, South Carolina (TA-W-39,813) in direct support of the Aquatech, Inc., Cookeville, Tennessee activities who became totally or partially separated from employment on or after August 1, 2000 through two years from the date of certification are eligible to apply for adjustment assistance under Section 223 of the Trade Act of 1974;" and
"I further determine that all workers at Greenwood Mills, Inc., Chalmers Plant, Greenwood, South Carolina (TA-W-39,813A) and Greenwood Mills, Inc., Lindale Manufacturing, Lindale, Georgia (TA-W-39,813B) are denied eligibility to apply for adjustment assistance under Section 223 of the Trade Act of 1974."
