Certification Regarding Eligibility
To Apply for Worker Adjustment Assistance

In accordance with Section 223 of the Trade Act of 1974
(19 USC 2273) as amended by the Omnibus Trade and Competitiveness Act of 1988 (P. L. 100-418), the Department of Labor herein presents the results of an investigation regarding certification of eligibility to apply for worker adjustment assistance.
In order to make an affirmative determination and issue a certification of eligibility to apply for adjustment assistance each of the group eligibility requirements of Section 222 of the Act must be met. It is determined in this case that all of the requirements have been met.
The investigation was initiated on August 6, 2001, in response to a petition filed by a company official on behalf of workers at DuPont Corporation, Polyester Enterprise, Dacron Polyester Fiber, Cape Fear Plant, Wilmington, North Carolina. The workers are engaged in activity related to the production of polyester fiber.
At the request of the company, the investigation was expanded to cover the following DuPont Corporation facilities: Kinston Plant, Kinston, North Carolina; Cooper River Plant, Charleston, South Carolina; the sales and marketing offices in Charlotte, North Carolina; and the administrative offices in Wilmington, Delaware.
The investigation revealed that overall production of polyester fiber and employment related to the production of polyester fiber declined during the relevant time period.
The investigation also revealed an increase of company import of polyester fiber during the relevant time periods.
The Department of Labor conducted a survey of the subject company's major customers regarding their purchases of polyester fiber.
The survey revealed an increase of customer reliance upon polyester fiber imports during the relevant time period.
There was a previous certification for the workers at the subject facilities, TA-W-35,961 (signed August 23, 1999).
Conclusion
After careful review, I determine that increased imports of articles like or directly competitive with polyester fiber produced by DuPont Corporation, Polyester Enterprise, Dacron Polyester Fiber, contributed importantly to the decline in sales or production and to the total or partial separation of workers at the following facilities: Cape Fear Plant, Wilmington, North Carolina; Kinston Plant, Kinston, North Carolina; Cooper River Plant, Charleston, South Carolina; sales and marketing offices, Charlotte, North Carolina; and administrative offices in Wilmington, Delaware.
In accordance with the provisions of the Act, I make the following certification:
"All workers of DuPont Corporation, Polyester Enterprise, Dacron Polyester Fiber, Cape Fear Plant, Wilmington, North Carolina, Kinston Plant, Kinston, North Carolina, Cooper River Plant, Charleston, South Carolina, engaged in employment related to the production of polyester fiber, and the sales and marketing offices, Charlotte, North Carolina, and the administrative offices in Wilmington, Delaware, who became totally or partially separated from employment on or after August 24, 2001 through two years from the date of certification are eligible to apply for adjustment assistance under Section 223 of the Trade Act of 1974."
