Certification Regarding Eligibility
To Apply for Worker Adjustment Assistance

In accordance with Section 223 of the Trade Act of 1974 (19 USC 2273) as amended by the Omnibus Trade and Competitiveness Act of 1988 (P. L. 100-418), the Department of Labor herein presents the results of an investigation regarding certification of eligi-bility to apply for worker adjustment assistance.
In order to make an affirmative determination and issue a certification of eligibility to apply for adjustment assistance each of the group eligibility requirements of Section 222 of the Act must be met. It is determined in this case that all of the requirements have been met.
The investigation was initiated in response to a petition received on August 6, 2001 on behalf of workers at Air-Way Manufacturing Company, Plant #1, Olivet, Michigan (TA-W-39,736). The investigation was expanded to include Air-Way Manufacturing Company, Plant #2, Olivet, Michigan (TA-W-39,736A); and, Air-Way Manufacturing Company, Edgerton, Ohio (TA-W-39,736B). The workers produced steel and stainless steel hydraulic fittings and adapters.
The investigation revealed corporate-wide sales and production decreased in FY 2001 compared to FY 2000 and in the first quarter of FY 2002 compared to the same period in FY 2001. Employment at all of the subject facilities decreased in FY 2001 compared to FY 2000.
The Department conducted a survey of a major declining customer of the subject firm regarding its purchases of steel hydraulic fittings in 1999, 2000 and January-June 2001. The survey revealed that the respondent increased its purchases of steel hydraulic fittings both directly and indirectly from foreign firms while decreasing its purchases of steel hydraulic fittings from the subject firm in 2000 compared to 1999.
Conclusion
After careful review of the facts obtained in the investi-gation, I conclude that increases of imports of articles like or directly competitive with steel and stainless steel hydraulic fittings and adapters produced at Air-Way Manufacturing Company, Plant #1, Olivet, Michigan; Air-Way Manufacturing Company, Plant #2, Olivet, Michigan; Air-Way Manufacturing Company, Edgerton, Ohio contributed importantly to the decline in sales or production and to the total or partial separation of workers of that firm. In accordance with the provisions of the Act, I make the following certification:
"All workers of Air-Way Manufacturing Company, Plant #1, Olivet, Michigan (TA-W-39,736); Air-Way Manufacturing Company, Plant #2, Olivet, Michigan (TA-W-39,736A);and Air-Way Manufacturing Company, Edgerton, Ohio (TA-W-39,736B), engaged in employment related to the production of steel and stainless steel hydraulic fittings and adapters, who became totally or partially separated from employment on or after July 21, 2000, through two years from the date of certification, are eligible to apply for adjustment assistance under Section 223 of the Trade Act of 1974."
