Notice of Determinations Regarding Eligibility
To Apply for Worker Adjustment Assistance
In accordance with Section 223 of the Trade Act of 1974 (19
USC 2273) as amended by the Omnibus Trade and Competitiveness Act of
1988 (P. L. 100-418), the Department of Labor herein presents the
results of an investigation regarding certification of eligibility
to apply for worker adjustment assistance.
In order to make an affirmative determination and issue a
certification of eligibility to apply for adjustment assistance each
of the group eligibility requirements of Section 222 of the Act must
be met:
(1) that a significant number or proportion of the workers in
the workers' firm, or an appropriate subdivision thereof,
have become totally or partially separated, or are
threatened to become totally or partially separated;
(2) that sales or production, or both, of the firm or
subdivision have decreased absolutely; and
(3) that increases of imports of articles like or directly
competitive with articles produced by the firm or
appropriate subdivision have contributed importantly to
the separations, or threat thereof, and to the absolute
decline in sales or production.
The investigation was initiated in response to a petition
received on July 9, 2001 and filed by International Union of
Electronic, Electrical, Salaried, Machine and Furniture Workers-
Communications Workers of America, Local 901 on behalf of workers at
General Electric Industrial Systems, Motors Division (TA-W-39,600),
General Electric Industrial Systems, Transformer Division (TA-W-
39,600A), and General Electric Industrial Systems, Magnetic Wire
Division (TA-W-39,600B) in Fort Wayne, Indiana. The workers produce
electric motors, dry type transformers, and copper and aluminum
magnetic wire, respectively. Workers are separately identifiable by
product line.
It has been determined with respect to workers at General
Electric Industrial Systems, Motors Division, Fort Wayne, Indiana
(TA-W-39,600) that all of the criteria have been met.
The investigation revealed that sales, production, and
employment at the subject firm declined from 1999 to 2000. The
investigation further revealed that the subject firm increased its
reliance on imported electric motors during the relevant time
period.
It has been determined with respect to workers at General
Electric Industrial Systems, Transformer Division, Fort Wayne,
Indiana (TA-W-39,600A) that all of the criteria have been met.
The investigation revealed that sales and employment at the
subject firm declined from the period of January through September
of 2000 to the same period in 2001. Furthermore, a Department of
Labor survey of the subject firm's customers revealed increased
imports of dry type transformers during the relevant time period.
It has been determined with respect to workers at General
Electric Industrial Systems, Magnetic Wire Division, Fort Wayne,
Indiana (TA-W-39,600B) that criterion (3) has not been met.
The investigation revealed no increases in imports of copper
and aluminum magnetic wire during the relevant period.
A petition for eligibility to apply for NAFTA-Transitional
Adjustment Assistance has been filed by International Union of
Electronic, Electrical, Salaried, Machine and Furniture Workers-
Communications Workers of America, Local 901 on behalf of workers of
the subject firm (NAFTA-5034; NAFTA-5034A; and NAFTA-5034B)
Conclusion
After careful review of the facts obtained in the
investigation, I conclude that increases of imports of articles like
or directly competitive with electric motors and dry type
transformers produced at General Electric Industrial Systems, Motors
Division (TA-W-39,600) and General Electric Industrial Systems,
Transformer Division (TA-W-39,600A) in Fort Wayne, Indiana,
contributed importantly to the decline in sales or production and to
the total or partial separation of workers of those firms. In
accordance with the provisions of the Act, I make the following
certification:
"All workers of General Electric Industrial Systems, Motors
Division (TA-W-39,600), General Electric Industrial Systems,
Transformer Division (TA-W-39,600A) in Fort Wayne, Indiana
engaged in employment related to the production of electric
motors and dry type transformers, who became totally or
partially separated from employment on or after June 21, 2000
are eligible to apply for adjustment assistance under Section
223 of the Trade Act of 1974."
"I further determine that all workers at General Electric
Industrial Systems, Magnetic Wire Division (TA-W-39,600B)
engaged in employment related to the production of copper and
aluminum magnetic wire, are denied eligibility to apply for
adjustment assistance under Section 223 of the Trade Act of
1974."
