Notice of Determinations Regarding Eligibility
To Apply for Worker Adjustment Assistance
In accordance with Section 223 of the Trade Act of 1974 (19 USC 2273) as amended by the Omnibus Trade and Competitiveness Act of 1988 (P. L. 100-418), the Department of Labor herein presents the results of an investigation regarding certification of eligi-bility to apply for worker adjustment assistance.
In order to make an affirmative determination and issue a certification of eligibility to apply for adjustment assistance each of the group eligibility requirements of Section 222 of the Act must be met.
The investigation was initiated in response to a petition received on June 25, 2001 and filed on behalf of workers and former workers at Superior Electric, Bristol, Connecticut. The workers produced motors, stepper drives, adjustable speed drives, and voltage control flash regulator equipment.
It has been determined with respect to workers at Superior Electric producing all products except VR motors and stators that criterion (3) has not been met.
The company is relocating and consolidating into other company plants most of the production of the subject facility. Production of all motors except VR motors and stators, stepper drives, and adjustable speed drives is being transferred to other domestic company facilities.
Company imports of stepper drives accounted for a very small percentage of sales of stepper drives in 1999 and 2000.
It has been determined with respect to workers at Superior Electric producing voltage control flash regulator equipment that criteria (1) and (3) have not been met.
Production of voltage control flash regulator equipment will remain at the subject facility pending sales of the business in 2001. There has been no separation of workers producing these products.
It has been determined with respect to workers at Superior Electric producing VR motors and stators that all of the criteria have been met.
The transfer of production of VR motors and stators from the subject facility to a foreign company facility began in July 2001. The company has already begun to import these products previously produced by workers at the subject facility.
Conclusion
After careful review of the facts obtained in the investi-gation, I conclude that increases of imports of articles like or directly competitive with VR motors and stators produced at Superior Electric, Bristol, Connecticut contributed importantly to the decline in sales or production and to the total or partial separation of workers of that firm. In accordance with the provisions of the Act, I make the following certification:
"All workers of Superior Electric, Bristol, Connecticut engaged in employment related to the production of VR motors and stators who became totally or partially separated from employment on or after June 7, 2000 are eligible to apply for adjustment assistance under Section 223 of the Trade Act of 1974."
"I further determine that all workers at Superior Electric, Bristol, Connecticut engaged in employment related to the production of motors (except VR motors and stators), stepper drives, adjustable speed drives, and voltage control flash regulator equipment are denied eligibility to apply for adjustment assistance under Section 223 of the Trade Act of 1974."
