Certification Regarding Eligibility
To Apply for Worker Adjustment Assistance
In accordance with Section 223 of the Trade Act of 1974 (19
USC 2273) as amended by the Omnibus Trade and Competitiveness Act
of 1988 (P. L. 100-418), the Department of Labor herein presents
the results of an investigation regarding certification of eligi-
bility to apply for worker adjustment assistance.
In order to make an affirmative determination and issue a
certification of eligibility to apply for adjustment assistance
each of the group eligibility requirements of Section 222 of the
Act must be met. It is determined in this case that all of the
requirements have been met.
The investigation was initiated in response to a petition
received on May 21, 2001 and filed on behalf of workers at M.
Fine & Sons Manufacturing Company, Inc., Middlesboro, Kentucky
(TA-W-39,286); M. Fine & Sons Manufacturing Company, Inc., New
York, New York (TA-W-39,339); M. Fine & Sons Manufacturing
Company, Inc., Louisville, Kentucky (TA-W-39,339A); M. Fine &
Sons Manufacturing Company, Inc., Dalton, Georgia (TA-W-39,339B);
M. Fine & Sons Manufacturing Company, Inc., New Albany, Indiana
(TA-W-39,412); and, M. Fine & Sons Manufacturing Company, Inc.,
Jeffersonville, Indiana (TA-W-39,412A). The investigation was
expanded to include M. Fine & Sons Manufacturing Company, Inc.,
Loretto, Tennessee (TA-W-39,286A); and, M. Fine & Sons Manufac
turing Company, Inc., Greenhill, Alabama (TA-W-39,286B). The
workers produced primarily mens' and boys' pants and shirts.
The investigation revealed that domestic company-wide
production and plant production of primarily men's and boys'
jeans at both the Middlesboro and Loretto plants declined in 2000
compared to 1999 and in January-April 2001 compared to the same
period in 2000. Employment at all subject facilities decreased in
the year ended April 2001 compared to the year ended April 2000.
U.S. imports of men's and boys' trousers, slacks, jeans and
pants increased in 1999 compared to 1998 and in the year ending
September 2000 compared to the year ending September 1999. In
1999, the ratio of imports to U.S. shipments was 181%.
The investigation further revealed that imports of men's and
boys' jeans by M. Fine & Sons Manufacturing Company Inc.
decreased only slightly absolutely and increased relatively in
2000 compared to 1999 and relatively in January-April 2001
compared to the same period in 2000.
Conclusion
After careful review of the facts obtained in the investi-
gation, I conclude that increases of imports of articles like or
directly competitive with men's and boys' jeans produced at M.
Fine & Sons Manufacturing Company, Inc., Middlesboro, Kentucky;
M. Fine & Sons Manufacturing Company, Inc., Loretto, Tennessee;
M. Fine & Sons Manufacturing Company, Inc., Greenhill, Alabama;
M. Fine & Sons Manufacturing Company, Inc., New York, New York;
M. Fine & Sons Manufacturing Company, Inc., Louisville, Kentucky;
M. Fine & Sons Manufacturing Company, Inc., Dalton, Georgia; M.
Fine & Sons Manufacturing Company, Inc., New Albany, Indiana;
and, M. Fine & Sons Manufacturing Company, Inc., Jeffersonville,
Indiana contributed importantly to the decline in sales or
production and to the total or partial separation of workers of
that firm. In accordance with the provisions of the Act, I make
the following certification:
"All workers of M. Fine & Sons Manufacturing Company, Inc.,
Middlesboro, Kentucky; M. Fine & Sons Manufacturing Company,
Inc., Loretto, Tennessee; M. Fine & Sons Manufacturing
Company, Inc., Greenhill, Alabama; M. Fine & Sons Manufac
turing Company, Inc., New York, New York; M. Fine & Sons
Manufacturing Company, Inc., Louisville, Kentucky; M. Fine &
Sons Manufacturing Company, Inc., Dalton, Georgia; M. Fine &
Sons Manufacturing Company, Inc., New Albany, Indiana; and,
M. Fine & Sons Manufacturing Company, Inc., Jeffersonville,
Indiana who became totally or partially separated from
employment on or after May 3, 2000 are eligible to apply for
adjustment assistance under Section 223 of the Trade Act of
1974."

Amended Certification Regarding Eligibility to
Apply for Worker Adjustment Assistance
In accordance with Section 223 of the Trade Act of 1974 (19
USC 2273) the Department of Labor issued a Notice of Certifica
tion Regarding Eligibility to Apply for Worker Adjustment Assis
tance on June 26, 2001, applicable to workers of M. Fine & Sons
Manufacturing Company, Inc., Loretto, Tennessee. The notice was
published in the Federal Register on July 11, 2001
(FR 66 36329).
At the request of the State agency, the Department reviewed
the certification for workers of the subject firm. The workers
are engaged in the production of primarily men's and boys' pants
and shirts. New findings show that the Department incorrectly
issued the certification to "all workers" of the Loretto, Tennes
see location of M. Fine & Sons Manufacturing Company, Inc. A
previous certification, TA-W-38,200, was issued on December 27,
2000, for workers of the subject firm's Loretto, Tennessee
location limited to workers who were engaged in employment
related to the production of blue jean finishing. That certifi
cation expires December 27, 2002.
The Department is amending the certification determination
to exclude workers, employed at the Loretto, Tennessee location,
who are engaged in employment related to the production of blue
jean finishing, who are previously covered under TA-W-38,200.
The intent of the Department's certification is to include
all workers of M. Fine and Sons Manufacturing Company, Inc.,
Loretto, Tennessee.
The amended notice applicable to TA-W-39,286A is hereby
issued as follows:
"All workers of M. Fine & Sons Manufacturing Co., Inc.,
Loretto, Tennessee, excluding those workers engaged in employment
related to the production of blue jean finishing, who are covered
by TA-W-38,200, who became totally or partially separated from
employment on or after May 3, 2000, through June 26, 2003, are
eligible to apply for adjustment assistance under Section 223 of
the Trade Act of 1974."
