Notice of Revised Determination
on Reconsideration

On February 11, 2002, the Department issued an Affirmative
Determination Regarding Application on Reconsideration applicable
to workers and former workers of the subject firm. The notice
will soon be published in the Federal Register.
The Department initially denied TAA to workers of United
States Steel, LLC, Fairless Hills, Pennsylvania, engaged in the
production of tin mill products because the "contributed
importantly" group eligibility requirement of Section 222(3) of
the Trade Act of 1974, as amended, was not met.
On reconsideration, the Department conducted further survey
of the major customers of the subject firm regarding their
purchases of tin mill products. The survey revealed that a major
customer significantly increased their imports, while decreasing
their purchases from the subject firm during the relevant period.







Conclusion
After careful review of the additional facts obtained on
reconsideration, I conclude that increased imports of articles
like or directly competitive with tin mill products, contributed
importantly to the declines in sales or production and to the
total or partial separation of workers of United States Steel,
LLC, Fairless Hills, Pennsylvania. In accordance with the
provisions of the Act, I make the following certification:
"All workers of United States Steel, LLC, Fairless Hills,
Pennsylvania engaged in the production of tin mill products
who became totally or partially separated from employment on
or after May 4, 2000 are eligible to apply for adjustment
assistance under Section 223 of the Trade Act of 1974."

Notice of Determinations Regarding Eligibility
To Apply for Trade Adjustment Assistance

In accordance with Section 223 of the Trade Act of 1974 (19
USC 2273) as amended by the Omnibus Trade and Competitiveness Act
of 1988 (P. L. 100-418), the Department of Labor herein presents
the results of an investigation regarding certification of eligi-
bility to apply for worker adjustment assistance.
In order to make an affirmative determination and issue a
certification of eligibility to apply for adjustment assistance
each of the group eligibility requirements of Section 222 of the
Act must be met.
The investigation was initiated on May 21, 2001, in response
to a petition filed by the United Steelworkers of America, District
10, on behalf of workers producing cold rolled sheet and cold
rolled tin at United States Steel LLC, AFairless Works,@ Fairless
Hills, Pennsylvania. United States Steel LLC is a subsidiary of
USX Corporation. Workers are separately identifiable between
sheet and tin mill steel products.
The petition does not include workers producing galvanized
steel at the plant.
It has been determined with respect to workers engaged in
employment related to the production of cold rolled steel that all
of the criteria have been met.



The investigation revealed that production and employment of
those engaged in the production of cold rolled steel at the plant
decreased during the period under investigation.
The Department of Labor surveyed major customers of the
subject firm regarding their purchases of cold rolled steel in the
1999-2000 and January to June, 2000-2001 time periods. Respondents
indicated that they reduced purchases from the subject firm and
increased imports in the relevant time periods. United States
aggregate imports of cold rolled carbon steel increased both
absolutely and relative to U.S. shipments in January through April,
2001 compared to the same period of the previous year.
It has also been determined with respect to workers of the
subject plant engaged in the production of tin mill products
that criterion (3) has not been met.
The Department of Labor surveyed a major customer of the
subject firm regarding their purchases of tin mill products in the
1999-2000 and January to July, 2000-2001 time periods. The
respondent indicated that all of their purchases have been from
domestic sources since early 2000.
United States aggregate imports of tin mill products declined
both absolutely and relative to U.S. shipments in 2000 compared
with 1999 and in January through April, 2001 compared to the same
period of 2000.
Conclusion
After careful review of the facts obtained in the investi-
gation, I conclude that increase in imports of articles like or
directly competitive with cold rolled sheet produced at the subject
firm contributed importantly to the decline in sales or production
and to the total or partial separation of workers at that firm. In
accordance with the provisions of the Trade Act, I make the
following certification:
"All workers at United States Steel LLC, Fairless Hills,
Pennsylvania, engaged in employment related to the production
of cold rolled steel who became totally or partially separated
from employment on or after May 4, 2000, through two years
from the date of certification, are eligible to apply for
adjustment assistance under Section 223 of the Trade Act of
1974."
AI further determine that all workers of United States Steel
LLC, Fairless Hills, Pennsylvania, engaged in employment
related to the production of tin mill products are denied
eligibility to apply for adjustment assistance under Section
223 of the Trade Act of 1974."
