Amended Certification Regarding Eligibility to
Apply for Worker Adjustment Assistance

In accordance with Section 223 of the Trade Act of 1974 (19 USC 2273) the Department of Labor issued a Notice of Certification Regarding Eligibility to Apply for Worker Adjustment Assistance on September 4, 2001, applicable to workers of McGinley Mills, Inc., Easton, Pennsylvania. The notice was published in the Federal Register on September 21, 2001 (66 FR 48707).
At the request of the company, the Department reviewed the certification for workers of the subject firm. The company reports that worker separations occurred at the Phillipsburg, New Jersey location of McGinley Mills, Inc. The Phillipsburg, New Jersey location produces woven greige goods needed for the production of ribbons and ribbon products at the Easton, Pennsylvania location of the subject firm.

Based on these findings, the Department is amending the certification to include workers of the Phillipsburg, New Jersey location of McGinley Mills, Inc.
The intent of the Department=s certification is to include all workers of McGinley Mills, Inc. who were adversely affected by increased imports.
The amended notice applicable to TA-W-39,265 is hereby issued as follows:
"All workers of McGinley Mills, Inc., Easton, Pennsylvania (TA-W-39,265) and McGinley Mills, Inc., Phillipsburg, New Jersey (TA-W-39,265A) who became totally or partially separated from employment on or after April 26, 2000, through September 4, 2003, are eligible to apply for adjustment assistance under Section 223 of the Trade Act of 1974.@

Certification Regarding Eligibility
To Apply for Worker Adjustment Assistance

In accordance with Section 223 of the Trade Act of 1974 (19 USC 2273) as amended by the Omnibus Trade and Competitiveness Act of 1988 (P. L. 100-418), the Department of Labor herein presents the results of an investigation regarding certification of eligi-bility to apply for worker adjustment assistance.
In order to make an affirmative determination and issue a certification of eligibility to apply for adjustment assistance each of the group eligibility requirements of Section 222 of the Act must be met. It is determined in this case that all of the requirements have been met.
The investigation was initiated on May 14, 2001, in response to a petition filed by UNITE! Of Gaithersburg, MD, on behalf of workers at McGinley Mills Inc., Easton, Pennsylvania. The workers were engaged in the manufacture of ribbons and ribbon products.
The investigation revealed that production and employment at the subject firm declined to zero on August 24, 2001, when the Easton plant was permanently shut down. The investigation fur-ther revealed that the subject firm has increased its imports of ribbons during the relevant period.

The U.S. Department of Labor conducted a survey of major customers of the subject firm concerning their purchases of ribbons in 1999, 2000, and January-June 2001. The survey revealed that major customers reported increasing their imports of ribbons while decreasing purchases from the subject firm during the relevant period.
Conclusion
After careful review of the facts obtained in the investi-gation, I conclude that increased imports from offshore of articles like or directly competitive with ribbons produced at McGinley Mills Inc., Easton, Pennsylvania, contributed impor-tantly to the decline in sales or production and to the total or partial separation of workers of that firm.
In accordance with the provisions of the Act, I make the following certification:
"All workers of McGinley Mills Inc., Easton, Pennsylvania, who became totally or partially separated from employment on or after April 26, 2000, through two years from the date of certification are eligible to apply for adjustment assistance under Section 223 of the Trade Act of 1974."
