Notice of Determinations Regarding Eligibility
To Apply for Worker Adjustment Assistance
In accordance with Section 223 of the Trade Act of 1974 (19 USC 2273) as amended by the Omnibus Trade and Competitiveness Act of 1988 (P. L. 100-418), the Department of Labor herein presents the results of an investigation regarding certification of eligi-bility to apply for worker adjustment assistance.
In order to make an affirmative determination and issue a certification of eligibility to apply for adjustment assistance each of the group eligibility requirements of Section 222 of the Act must be met.
The investigation was initiated in response to a petition received on April 23, 2001 and filed by International Union of United Automobile, Aerospace and Agricultural Implement Workers of America, Region 1 D, on behalf of workers and former workers at Thomson Saginaw Ball Screw Company LLC, Saginaw, Michigan (TA-W-39,067); and, Thomson Saginaw Ball Screw Company LLC, Cut Center, Saginaw, Michigan (TA-W-39,067A). Thomson Saginaw Ball Screw Company LLC is a subsidiary of Thomson Industries. The petition was filed on behalf of workers producing Performance Pak actuators at Thomson Saginaw Ball Screw Company LLC, Saginaw, Michigan and 60 Case LinearRace shafts at Thomson Saginaw Ball Screw Company LLC, Cut Center, Saginaw, Michigan.
It has been determined with respect to workers at Thomson Saginaw Ball Screw Company LLC, Cut Center, Saginaw, Michigan producing 60 Case LinearRace shafts that criterion (3) has not been met.
The Department conducted a survey of major customers of the Saginaw Cut Center regarding their purchases of steel shafting in 1999 and 2000. The survey revealed that none of the respondents imported in the relevant period.
It has been determined with respect to workers at Thomson Saginaw Ball Screw Company LLC, Saginaw, Michigan producing Performance Pak actuators that all of the criteria have been met.
The company shifted final assembly production of Performance Pak actuators from the subject plant to a foreign facility until the Spring of 2000. These products are now being imported.
Conclusion
After careful review of the facts obtained in the investi-gation, I conclude that increases of imports of articles like or directly competitive with Performance Pak actuators produced at Thomson Saginaw Ball Screw Company LLC, Saginaw, Michigan contributed importantly to the decline in sales or production and to the total or partial separation of workers of that firm. In accordance with the provisions of the Act, I make the following certification:
"All workers of Thomson Saginaw Ball Screw Company LLC, Saginaw, Michigan engaged in employment related to the production of Performance Pak Actuators who became totally or partially separated from employment on or after April 3, 2000 eligible to apply for adjustment assistance under Section 223 of the Trade Act of 1974."
"I further determine that all workers at Thomson Saginaw Ball Screw Company LLC, Cut Center, Saginaw, Michigan are denied eligibility to apply for adjustment assistance under Section 223 of the Trade Act of 1974."
