Certification Regarding Eligibility
To Apply for Worker Adjustment Assistance
In accordance with Section 223 of the Trade Act of 1974 (19
USC 2273) as amended by the Omnibus Trade and Competitiveness Act
of 1988 (P. L. 100-418), the Department of Labor herein presents
the results of an investigation regarding certification of eligi-
bility to apply for worker adjustment assistance.
In order to make an affirmative determination and issue a
certification of eligibility to apply for adjustment assistance
each of the group eligibility requirements of Section 222 of the
Act must be met. It is determined in this case that all of the
requirements have been met.
The investigation was initiated in response to a petition
received on April 16, 2001 and filed jointly by the United
Steelworkers of America, Local 8319, and the company on behalf of
workers at Magnesium Corporation of America, Salt Lake City,
Utah. The workers produced primary pure and alloy magnesium.
The investigation revealed U.S. imports of magnesium metal
increased absolutely in 1999 compared to 1998 and decreased
absolutely and relative to U.S. consumption of primary magnesium
metal only slightly in 2000 compared to 1999.
U.S. imports of magnesium raspings, turning and granules,
grade according to size; powders increased absolutely in January
2001 compared to January 2000.
The Department conducted a survey of major declining custom
ers of the subject firm regarding their purchases of pure magne
sium in 1999 and 2000. The survey revealed that respondents which
accounted for a significant percentage of the subject firm's
decline in sales of pure magnesium in 2000 compared to 1999
increased their purchases of pure magnesium from foreign firms
while decreasing their purchases of pure magnesium from the
subject firm in 2000 compared to 1999.
The Department conducted a survey of major declining custom
ers of the subject firm regarding their purchases of alloy
magnesium in 1999 and 2000. The survey revealed that a respondent
which accounted for a significant percentage of the subject
firm's decline in sales of alloy magnesium in 2000 compared to
1999 increased their purchases of alloy magnesium from foreign
firms while decreasing their purchases of alloy magnesium from
the subject firm in 2000 compared to 1999.
Conclusion
After careful review of the facts obtained in the investi-
gation, I conclude that increases of imports of articles like or
directly competitive with primary pure and alloy magnesium
produced at Magnesium Corporation of America, Salt Lake City,
Utah contributed importantly to the decline in sales or produc
tion and to the total or partial separation of workers of that
firm. In accordance with the provisions of the Act, I make the
following certification:
"All workers of Magnesium Corporation of America, Salt Lake
City, Utah engaged in employment related to the production
of primary pure and alloy magnesium who became totally or
partially separated from employment on or after April 3,
2000 through two years from the date of certification are
eligible to apply for adjustment assistance under Section
223 of the Trade Act of 1974."
