Amended Certification Regarding Eligibility to
Apply for Worker Adjustment Assistance
In accordance with Section 223 of the Trade Act of 1974 (19
USC 2273) the Department of Labor issued a Notice of
Certification Regarding Eligibility to Apply for Worker
Adjustment Assistance on June 18, 2001, applicable to workers of
Astaris LLC, Pocatello, Idaho. The notice was published in the
Federal Register on June 5, 2001 (66 FR 35463).
At the request of the company, the Department reviewed the
certification for workers of the subject firm. The workers were
engaged in the production of elemental phosphorus.
New information shows that worker separations occurred at
the Princeton, New Jersey and Denver, Colorado locations of
Astaris LLC when they closed in November 2001 and January 2002
respectively. These locations provided technical research and
engineering support services solely to the subject firms=
production facility in Pocatello, Idaho which closed in 2001.
Accordingly, the Department is amending the certification to
include the workers of the Princeton, New Jersey and Denver,
Colorado locations of Astaris LLC.
The intent of the Department=s certification is to include
all workers of Astaris LLC who were adversely affected by
increased imports.
The amended notice applicable to TA-W-39,009 is hereby
issued as follows:
"All workers of Astaris LLC, Pocatello, Idaho (TA-W-39,009),
Astaris LLC, Princeton, New Jersey (TA-W-39,009A) and
Astaris LLC, Denver, Colorado (TA-W-39,009B) who became
totally or partially separated from employment on or after
April 2, 2000, through June 18, 2003, are eligible to apply
for adjustment assistance under Section 223 of the Trade Act
of 1974."

Certification Regarding Eligibility
To Apply for Worker Adjustment Assistance
In accordance with Section 223 of the Trade Act of 1974 (19 USC 2273) as amended by
the Omnibus Trade and Competitiveness Act of 1988 (P. L. 100-418), the Department of Labor
herein presents the results of an investigation regarding certification of eligi-bility to apply for
worker adjustment assistance.
In order to make an affirmative determination and issue a certification of eligibility to
apply for adjustment assistance each of the group eligibility requirements of Section 222 of the
Act must be met. It is determined in this case that all of the requirements have been met.
The investigation was initiated in response to a petition received on April 9, 2001 and
filed on behalf of workers at Astaris LLC, Pocatello, Idaho. The subject firm is a joint venture of
Solutia and FMC. The workers produced elemental phosphorus.
The investigation revealed that plant production and employment decreased in the third
quarter of 2000 compared to the second quarter of 2000 and in the first quarter of 2001 compared
to the fourth quarter of 2000.
U.S. imports of phosphorus increased in 2000 compared to 1999 and in January-March
2001 compared to the same period in 2000.
The investigation further revealed that imports of elemental phosphorus and phosphoric
acid by Astaris LLC increased in January-March 2001 compared to the same period in 2000.
Conclusion
After careful review of the facts obtained in the investi-gation, I conclude that increases
of imports of articles like or directly competitive with elemental phosphorus produced at Astaris
LLC, Pocatello, Idaho contributed importantly to the decline in sales or production and to the
total or partial separation of workers of that firm. In accordance with the provisions of the Act, I
make the following certification:
"All workers of Astaris LLC, Pocatello, Idaho who became totally or partially separated
from employment on or after April 2, 2000 through two years from the date of certifica-
tion are eligible to apply for adjustment assistance under Section 223 of the Trade Act of
1974."
